The contracting authority will answer the ground1 day before the deadline set for the submission of tenders, to the extent that they were addressed within the deadline provided in section I.1) of the data sheet (15 days).
The participation guarantee is for each lot in the amount of:

Valabilitate: 120 zile de la termenul limita-to receive bids. The equivalent of RON / foreign currency will be made at the exchange rate communicated by the NBR from the date before the deadline for submitting bids by 5 days. According to art. 36 par. (1) of GD 395/2016 is constituted by bank transfer or by a guarantee instrument issued under the law, by a bank or by an insurance company and shall be presented in theform with Form 1.
The participation guarantee will be loaded in the SEAP, for each lot, in the dedicated section, with the tenderer's electronic signature, by the deadline and time of submission of tenders.
The participation guarantee will be deposited only in SEAP until the deadline for submitting bids. After this date, the contracting authority may request (by clarification) the lodgement of the guaranteeof the participation in the original only if the document proving the constitution of the participation guarantee is part of the category of the special-purpose documents whose validity is conditioned by the presentation in the original form

Inconsistencies with prin the form of the participation guarantee, will be clarified by the evaluation committee with the bidders within maximum 3 working days from the deadline for submission of tenders, under the sanction of rejection of the offer as unacceptable (Article 132 paragraph (3) of the GD No 395/2016). The amount of the good execution guarantee instrument is 10% of the value of the subsequent contract, excluding VAT. Garantiof the good execution will be made within 5 working days from the date of signing the subsequent contract, according to the provisions of art. 40 par. (1) of GD 395/2016. The deposit guarantee is made in the Treasury account of the purchaser, subject to confirmation by the issuing bank, in favor of the contracting authority.
Funds from own revenues.each batch (Lot 1 20), the Bidder / associated bidder, the supporting third party and the subcontractor, and if the offer is submitted by an association, each associate (including the leader) must not find themselves in the situations provided for in art. 58 63, art. 164, art. 165 and art. 167 of Public Procurement Act 98/2016.
In order to prove the fulfillment of the requirements, the DUAE will be completed by following-that at the request of the contracting authority, the supporting documents related to those assumed by filling in the DUAE are submitted only by the bidder ranked first in the ranking drawn up at the completion of the evaluation of the bids. on the payment of taxes, duties or contributions to the general budget(2) The judicial record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator, or those having the power to represent them, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; 3) Dcase, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016
4) Other editorial documents, as appropriate.
If applicable, bidders will present together with the DUAE a list of the identification data of the third supporters / subcontractors in viewcompliance with the provisions of art. 63 par. (2) of Law 98 / 2016.
Note: The contracting authority shall exclude from the procedure any bidder / associate / third party / subcontractor falling within any of the situations provided for in art. 164, art. 165 and art. 167 of Law no. 98 / 2016.
The European Unique Acquisition Document (DUAE) will be completed in accordance with Art. 193 of Law 98/2016.
All documents requested by the contracting authority will be submitted by the tenderer by electronic means in SEAP, in the dedicated section, signed with an extended electronic signature based on a qualified certificate, according to Law no. 455/2001, republished, regarding the electronic signature. In case the electronic signature certificate does not belong to the legal representative of the tendererThe documents issued in a language other than the Romanian language will be presented in the language in which they were issued, accompanied by an authorized translation in Romanian. All documents will have, besides the signature, the full name of the signatory clearly.

For each distinct lot (Lot 1 20), the presentation of the Certificate of Attestation issued by the Trade Registry Office stating that the tenderer is entitled to carry out activities similar to those covered by this procurement (the object of the contract must have a correspondent in NACE code from the certifying certificate issued by the ONRC.) Note: certifythe disclosure statement will be submitted electronically, through the SEAP, having incorporated, attached or logically associated with the extended electronic signature (Notification ONRC_Service InfoCert_AC_0)

For legal persons / physical foreign:
In the case of tenderers of a different nationality than the Romanian one, documentthey will be transmitted in the language of origin, accompanied by a certified translation in Romanian. Documents concerning the object of activity of the economic operator (according to the provisions of Article 173 of Law No. 98/2016, with subsequent amendments and completions). How to meet and apply in the procedure: Documents to prove will be presented-a form of registration / attestation or affiliation.
