The subject of the order is the provision of services related to the development of green areas, including: preparatory work, delivery of plant material, planting high, medium and low vegetation as well as execution of lawns and flower meadows as part of the p projectn. "Development and renewal of the Opole area greenery and their comprehensive care during the warranty period. The works will be carried out in the following locations and quantities by division into 7 parts in accordance with the provisions of SIWZ available at www.mzd-opole.logintrade.net

The subject of the order is the provision of services related to the development of green areas, including: works przygotowawcze, delivery of plant material, implementation of planting high, medium and low vegetation, as well as execution of lawns and flower meadows as part of the project entitled. "Development and renovation of the Opole area greenery and their comprehensive care during the warranty period. The works will be carried out in the following locations and quantities by division into 7 parts in the further part of the ToR, exchangeable fortasks: - Task 1 Opole center deadline for completion until 31/10/2019 r.

The ordering party waives the specifiedia of this condition of participation in the proceedings. Due to the lack of space in the advertisement: 2. In order to demonstrate the absence of grounds for exclusion from the procurement procedure in the circumstances referred to in Article 24 sec. 1 item 12-23 u.p. and art. 24 sec. 5 pt. 1 p.p., the Purchaser requests submission of the following documents:

1) information from the National Criminal Register inreferred to in Article 24 sec. 1 points 13, 14 and 21 p.p. and, regarding the conviction for a prison sentence, to the extent specified by the ordering party under art. 24 sec. 5 points 5 and 6 unpublished, issued not earlier than 6 months before the deadline for submission of tenders or applications for admission to participate - In the proceedings, the Employer in accordance with the provisions of art. 26 par. 1 u.p. callNot the contractor whose offer has been rated the most, to submit this document in a specified period, not shorter than 10 days;

2) certificate of the competent head of the tax office confirming that the contractor is not in default of paying taxes, issued not earlier than 3 months before the deadline submitting offers or requests to participate in the procedure, oranother document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments or suspension in full of the decision of the competent authority Ordering party in accordance with the provisions art. 26 par. 1 u.p.z.p. will call the Contractor whose offer has been rated the most, to submit this document in a specified period of not shorter than 10 days; 3) a certificate of the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears social security contributionsor health care, issued not earlier than 3 months before the deadline for submitting bids or applications for admission to participate in the proceedings, or other document confirming that the contractor has concluded an agreement with the competent authority regarding the repayment of such receivables with possible reductions or fines, peculiarities obtained the legally required exemption, postponement or distributionnot on installments of overdue payments or withholding in full the implementation of the decision of the competent authority Ordering party in accordance with the provisions of art. 26 par. 1 u.p. call the Contractor whose offer has been rated the most, to submit this document in a specified period, not shorter than 10 days;

4) In order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 pts 1 p.p.z.p. orderingwill provide a copy of the relevant register or central records and business information, if separate regulations require an entry in the register or records - Ordering party in accordance with the provisions of art. 26 par. 1 u.p. will call the Contractor whose offer has been rated the most, to submit this document in the specified, not shorter than 10 days, period of 5) statementa person who fails to issue a final court decision or a final administrative decision about defaulting taxes, fees or social security or health insurance premiums or - in the event of such a verdict or decision - documents confirming payment of such claims together with any interest or fines; conclusion of a binding agreement inthe payment of these amounts due to the Ordering Party in accordance with the provisions of art. 26 par. 1 u.p. call the Contractor whose offer has been rated the most, to submit this document in the shortened date, not shorter than 10 days;

6) the contractor`s statement about the lack of a ruling against him as a preventive measure for the prohibition of applying for public procurement Z Gwith the provisions of art. 26 par. 1 u.p. will call the Contractor whose offer has been rated the most, to submit this document in the shortened period, not shorter than 10 days; - 7) the contractor`s statement on whether or not to belong to the same capital group; in the case of affiliation to the same capital group, the contractor may submit together with the declaration documents orinformation confirming that connections with another contractor do not lead to distortion of competition in the Procurement procedure in accordance with the provisions of art. 26 par. 1 u.p. will call the Contractor whose offer has been rated the most, to submit this document in the designated, not shorter than 10 days, deadline

8) In order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 5 and pkt 6 u.p.z.p. the contracting authority requests a statement from the contractor about the lack of a final conviction of a conviction court for a restriction of liberty or a fine to the extent specified by the awarding entity under Art. 24 sec. 5 points 5 and 6 u.p. - Employer in accordance with the provisions of art. 26 par. 1 u.p. will call the Contractor whose offer has been rated the most, to submit a niniof the document in a specified period, not shorter than 10 days,

9) In order to confirm the absence of grounds for exclusion pursuant to art. 24 sec. 5 p. 7 p.p.z.p. The contracting authority requests submission of the contractor`s statement on the lack of a final administrative decision on violation of the obligations under the labor law, environmental law or regulations on public securityto the extent specified by the contracting authority on the basis of art. 24 sec. 5 pts 7 p.p. - Employer in accordance with the provisions of art. 26 par. 1 u.p. will call the Contractor whose offer has been rated the most, to submit this document in a specified period, not shorter than 10 days,

10) In order to confirm the absence of grounds for exclusion pursuant to art. 24 sec. 5 p. 8 u.p.z.p Ordering partywill give the Contractor`s statement about the Contractor`s statements about non-payment of taxes and local fees, referred to in the Act of January 12, 1991 on taxes and local fees (Journal of Laws of 2016, item 716) - Employer in accordance with provisions of art. 26 par. 1 u.p. call the Contractor whose offer has been rated the most, to submit this document in the designated, not shorter than 10 days.

3. If the contractor has a registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to above in Chapter 10 point 2: a) point 1), he shall submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractorand the person who is the subject of information or a document is located or residing in the area specified in art. 24 sec. 1 items 13, 14 and 21 and par. 5, item 5 and 6 of the Code of Association,

b) items 2, 3, 4) - submits a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that: - is not in arrears with paying taxes, taxt, social security or health insurance premiums or that he / she concluded an understanding with the competent authority regarding repayment of such receivables with possible interest or fines, in particular he obtained the legally required exemption, deferral or installment payment of overdue payments or suspension in full of the decision of the competent authority authority, - its liquidation has not been opened or announceddeadness.

Proceedings are conducted in the form of an unlimited tender.

Chapter 5. Partial orders

1. The Contracting Party allows partial bids to be submitted.

2. According to the provisions of art. 36aa uPzp The Contracting Authority informs the Contractors that it limits the number of parts of the orders that will be awarded to one Contractor. The Employer intends to grant one Contractor of the mak2 parts of orders. 2. If one Contractor was to obtain a greater number of parts of the order than the maximum number for which the order may be awarded, the Ordering Party will accept as the selection criterion the lowest total amount of the order, unless only one offer applies for more than two parts in the contract award procedure orders. In suchto them, the objection indicated in point 2 will not apply
