The subject of the order is the preparation of the Project (project documentation including construction and executive design) for the construction of:

Water supply network with connections in Poznań as part of the investment project 3-05-06-020-0 "Poznań - water supply network in the area of ul. . Janikowska "together with obtaining a valid building permit and performing author's supervision in phasesand the implementation of the work carried out on the basis of the documentation being the subject of the order from the date of the contract with the contractor construction works to sign the final acceptance protocol of these robots.

The detailed description of the subject of the Order is presented in Part II of this SIWZ [Description of the subject of SIWZ II].

1. Contractors who are not subject to exclusion may participate in the proceedingsfrom the proceedings for granting the order in the circumstances referred to in Article 24 sec. 1 point 12-23 of the PPL (with the exclusion referred to in Article 133 paragraph 4 of the PPL), art. 24 sec. 1, 3, 5, 6 and 8 Pzp and who meet the conditions for participation in the proceedings regarding: a) competence and entitlements to conduct a specific professional activity, if it results from separate regulations, b) economic situationand financial, c) technical and professional capacity.

2. In order to confirm the absence of grounds for exclusion from the proceedings and to confirm compliance with the conditions of participation in the proceedings, the Contractor will be required to provide the Employer with the following declarations and documents (within the deadlines indicated in the ToR): a) Contractor's statement constituting preliminary confirmation of the lack of grounds for exclusiona, placed on the form of a single European order document (hereinafter: "EAT"), model provided for in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standard single European order document (EU OJ L series 2016, No. 3, page 16.) Note: the EAT declaration shall be submitted together with the offer only in electronic form, accompanied by qualifiede. a copy from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 Pzp;

c) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, will issueno earlier than 3 months before the deadline for submission of tenders or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables, including any interest or fines, in particular has obtained the legally required exemption, postponement or distribution of overdue payments into installments or suspension in full of the implementation of the decisionand d) a certificate from the relevant local organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders or another document confirming that youthe contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension of the execution of the decision of the competent authority;

e) information from the National Criminal Register in the scope specified in art. 24 sec. 1 points 13, 14 and 21 lipsyou and, regarding the conviction for a prison sentence, to the extent specified by the Employer pursuant to art. 24 sec. 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

f) a statement by the Contractor regarding the lack of grounds for exclusion specified in art. 24 sec. 1 item 15 and 22 of the PPL and art. 24 sec. 5 points 5-6 PPL (attachment No. 5 to the ToR).

The ordering party does not place any specific requirements regarding the economic and financial situation.

1. In order to confirm the lack of grounds for exclusion from the procurement procedure in the circumstances referred to in art. 24 sec. 1 point 23 PPL, the contractor will be required to submit a declaration of affiliationand / or lack of belonging to the same capital group. The contractor should submit this declaration within 3 days from the date of placing by the ordering party on the website, information referred to in art. 86 par. 5 Pzp. The pattern of the statement is included in Annex 4 to the ToR.

2. In the proceedings for the ordering, communication between the Employer and the Contractors shall take place invia the e-Ordering platform https://aquanet.ezamawiajacy.pl and e-mail to the following e-mail address: malgorzata.danekk@aquanet.pl, with the reservation that the submission of an offer together with JEDZ takes place only through the e-platform Purchaser.

3. The Contractor joining the proceedings for granting this public order, i.e. free of charge by registering or logging in, If you have an account in the e-Ordering platform, you accept the terms of use of the platform, set out in the Regulations posted on the website https://aquanet.ezamawiajacy.pl and consider it binding.

4. The functionalities of the e-Contracting platform are described in the User's Manual of the Contractor, constituting Annex 8 to this ToR.

5. The offer must be madeon electronic form under pain of nullity. The Contractor submits the offer on the e-Contracting platform.

6. The deadline by which the contractor will be bound by the submitted offer is 60 days. According to art. The 85th Pzp running the period starts with the expiry of the deadline for submission of tenders
