The bidders, third parties and subcontractors must not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98/2016. Will be filled in the statement on non-compliance in situprovided for in Art. 60 of Law no. 98/2006: Form 5 - will be completed by the bidder and associate / third party or subcontractor with the DUAE. The DUAE will be filled in by the economic operators participating in the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, -at the request of the contracting authority, only by the tenderer ranked 1st in the intermediate rankings drawn up at the end of the evaluation of the tenders. These documents may be: - - certificates for the absence of overdue debts, regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation;the judicial oversight of the economic operator and of the members of the management, management or supervisory body of the economic operator or of those having the power of representation, decision or control within the economic operator as it results from the certifying certificate issued by the ONRC / act constitutive,

- as the case may be, documents demonstrating that the economic operator canbenefits from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, - other editing documents, as the case may be.

The object of the contract must correspond to the domainof the activity mentioned in the document / documents.

The UAAE will be filled in by the economic operators participating in the award procedure, with the information related to their situation

Notes:

1) The Certificate of Attorney issued by the ONRC or, in the case of foreign tenderers, the documents equivalents issued in the country of residence are to be submitted at the request of the contracting authorityr by the tenderer ranked in the 1st rank in the intermediate rankings drawn up at the completion of the evaluation of the tenders; 2) In the case of documents issued in a language other than the Romanian language, they shall be accompanied by the authorized translation into the Romanian language. over the last 3 financial years ended: 2015, 2016, 2017. The turnover must be at least equal to$ 800, 000.00. The RON / EUR equivalent will be achieved at the average annual rate communicated by the NBR for those years. Tenderers who have to convert currencies other than the RON in RON will use the annual average exchange rates set by the National Bank of Romania for those years.
