Supply of drugs from the Cladribinum, Ocrelizumabum drug programs 2 tasks

Position No. 1 Cladribinum 1 task

The contractor will meet the condition if he demonstrates that he has the competence or authority to conduct a specific professional activity, i.e. he haspharmaceutical permission to operate a pharmaceutical warehouse in accordance with the provisions of the Act on freedom of economic activity (i.e. Journal of Laws of 2010, No. 220, item 1447, as amended).

The Purchaser does not set a condition in this respect.

1) IV.2.6) The minimum period during which the bidder will be bound by the offer 60 days.

2) The Awarding Entity will call the Contractor whose bid is the highest before awarding the contract.it, to be submitted within a designated period, not shorter than 10 days, valid at the date of submission of the following statements or documents:

a) a current excerpt from the relevant register or from the central register and information on economic activity, if separate provisions require an entry in the register or register in order to demonstrate the lack of grounds for exclusion based on art. 24 paragraph 5 point 1 of the ActPublic Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

b) current information from the National Criminal Register in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

c) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with payment afterdonations, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption, deferral or distribution provided for by law installments of late payments or withholding in fullof the implementation of the decision of the competent authority;

d) a certificate of the appropriate organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission offers or other dockment confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these claims together with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments as provided for by law or withholding in full the execution of the decision of the competent authority;

e) permit running a pharmaceutical warehouse in accordance with the provisions oftawy on the freedom of economic activity (i.e. Journal of Laws of 2010, No. 220, item 1447, as amended) should be presented in the form of an original or photocopy certified as a true copy by the Contractor;

f) the Contractor`s statement that he will have current and valid for the entire duration of the marketing authorization agreement for each medicinal product offered in accordance with the Act of 6.9.2001.pharmaceutical (i.e. Journal of Laws of 2008 No. 45, item 271).

3) The Contractor is obliged to pay a deposit in the amount of PLN 29, 344.00 (in words: twenty-nine thousand three hundred sixty-four zlotys 00/100) before the expiry deadline for submitting offers.

4) Change of provisions of the contract, withdrawal from the contract

1. Changing the provisions of the contractthat occur with the consent of both parties in writing, otherwise being null and void.

2. It is unacceptable, under pain of nullity, to amend this contract and introduce such provisions to it that would be detrimental to the Employer if, taking them into account, the content of the offer should be changed, on the basis of which the Contractor was selected, unless one of the conditions prevailing speechin art. 144 section 1 1e of the Public Procurement Law.

3. The contract may be changed if:

a) the financing of the medical procedure by the National Health Fund decreases and this procedure is directly related to the subject of the contract resulting from this contract; in such a situation, the

unit price of the subject of the contract will be reduced, while the will of the parties will depend on whether the prothe partial value of the contract will be reduced while leaving the quantity of products unchanged, or the value of the contract will remain unchanged with a simultaneous proportional increase in the number of products;

b) force majeure will occur that will directly affect the circumstances of the contract,

c) the product catalog numbers will be changed, subject toin the absence of higher price changes and at the same time maintaining at least the parameters of the ordered item,

d) there will be a sudden recession or other unforeseen circumstances independent of either Party (economic, political, social, atmospheric, etc.) that will directly affect the circumstances

performance of the contract.

4. It is allowed to change the contract in the subject matter, i.e.t replacement of the product covered by the contract with an equivalent in the case of:

a) discontinuation of the manufacturer`s range of products covered by the contract,

b) expiry of the registration certificate,

c) submission by the contractor of a more favorable offer for the Employer.

5. The change referred to in para. 4, will be admissible provided that the equivalent: will meet all the Employer`s requirements set out inspecification of essential terms of the order, will not have

lower parameters than the offer offered and will be used at least in the same indications as the product range covered by the contract and at a price not higher than the price of the product range

covered by the contract.

6. The changes referred to above may also apply to the method of packaging the assortment.

7. In a situation where during the periodthe contract will not be ordered the entire range specified therein, and there will be circumstances justified by the Employer`s needs, the parties allow the possibility of extending the duration of the contract for a period allowing the use of the range in the amount necessary for the functioning of the Employer related to his activities to settle a new tender procedure regarding the identical range ofb the value of the contract has been exhausted, but for a period not exceeding 4 months from the date specified in - 5.

8. In the event of a significant change in circumstances that means that performance of the contract is not in the public interest, which could not have been foreseen at the time of the conclusion of the contract, or further performance of the contract

may endanger the essential interest of national security or public security, he ordersthe contractor may withdraw from the contract within 30 days of becoming aware of these circumstances. In this case, the contractor may only demand remuneration due for performing part of the contract.
