1) The economic operators will complete the DUAE through the SICAP, for information on the completion, rescue, loading in the public procurement system will be sealedecta the guide made available to economic operators by AADR;

2) Participation in the procedure is allowed to all economic operators, irrespective of nationality, both authorized natural persons and legal entities. All the documents required for the purpose of demonstrating the fulfillment of the qualification criteria will be presented in Romanian. In the case of bidders of other nationalitiesthan the Romanian one, the documents will be transmitted in the language in which they were issued, accompanied by an authorized translation of them into the Romanian language;

3) If 2 or more offers are ranked first, with equal scores, the division it will be done taking into account the score obtained by the evaluation factors in descending order of their weights. In the situation where equality is maintainedkeep, the contracting authority has the right to request new financial proposals, through the electronic system e-bidding.ro and the winning bid will be designated the one with the smallest financial proposal, according to the provisions of art. 139 para. (3) of H.G. no. 395/2016, with the subsequent modifications and completions;

4) The operators will send the requests for clarifications regarding the documentationtakes the award only through the dedicated section of the SICAP platform, at the latest 19 days before the deadline for submission of tenders. The contracting authority shall respond to requests for clarifications at least 10 days before the deadline for submission of tenders. The contracting authority will respond to requests for clarifications transmitted by means other than SICAP only.that, for reasons related to SICAP`s operability and not attributable to the economic operator, they could not be transmitted within the deadline established by the contracting authority through the platform; to be managed and processed by the Contracting Authority, inaccording to EU Regulation no. 679 of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of these data, with mandatory applicability starting with 25.5.2018, art. 4 point 11 and art. 6.
