The way to prove the fulfillment of the requirement:

The DUAE will be filled by the economic operators participating in the award procedure with the information related to their situation

The supporting documents proving the fulfillment of the assumed by the completion of the DUAE are to be presented, at the request of the contracting authority, only by the tenderer clranked in the first place in the intermediate rankings drawn up during the evaluation of the tenders.

These documents are: a) certificates showing the lack of overdue debts, taxes, or contributions to the consolidated general budget (local budget, state) at the time of their filing.

b) criminal record of the economic operator and the members of the organ(c) as the case may be, the management, supervision or supervision of that economic operator or those having the power of representation, decision or control, as it results from the certifying certificate issued by the ONRC / documents demonstrating that the economic operator may benefit from the derogations provided for in Article 166 paragraph 2, art. 167 alin 2, art. 171 of the Public Procurement Law 98/2016

d) other editorial documents, as the case may be.

2) Statement regarding the non-compliance in the situations stipulated in art.59 - 60 of the law no.98 / 2016 regarding the conflict of interests.

Mode of accomplishment: The economic operator will complete and submit the DUAE form in the awarding documentation, and this statement will be submitted only bythe tenderer ranked first (including the associated bidder, the subcontractor or the supporting third party), after applying the award criterion, until the date of the award report, according to art. 196, par. (2) of Law no.98 / 2016 on public procurement.

The economic operators submitting the bid must provea form of registration under the law of the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment and that he has the professional capacity to carry out the activities that are subject to of the contract.

Mode of accomplishment: completion of the DUAE, followed by the supporting document, respectivelythe extended ONRC certificate or equivalent foreign equivalent issued in the country of residence (in the language in which it was issued, accompanied by the translation into Romanian made obligatory by authorized translators), be submitted at the request of the contracting authority only by the tenderer ranked I in the intermediate rankings completed at the evaluation of the bids.

If the first ranked offers have equal prices, the contracting authority will ask for clarifications through SEAP, for the electronic loading by the economic operators of documents containing the new prices. If, until sat the time specified in the contracting authority's request, no documents containing the new prices will be understood that the financial proposals initially filed by the deadline for the submission of tenders mentioned in the tender notice are firm and will be considered by the commission evaluation when establishing the winning bid
