1. The subject of the order is the delivery of medicines, dietary foods for special nutrition and equipment-U. for the Voivodship Hospital in Łomża in quantities, assortments and requirements specified in Annex 1 to the ToR. Number of parts (packages): 100.

The Ordering Party will consider that the Contractor has the right to conductbusiness activity, if the Contractor demonstrates that he has: a) the authorization to run a pharmaceutical wholesaler in accordance with the Pharmaceutical Law of November 6, 2001 (Journal of Laws of 2017, item 2211, as amended) in the case of an offer for medicinal products;

Or

b) permission for the manufacture of medicinal products in accordance with the Act of 6.9.2001. Pharmaceutical Law (ie Dz.E. from 2017 item 2211 from late zm.) in the case of an offer for medicinal products by the Contractor being the manufacturer of the medicinal product;

and

c) the license to conduct wholesale trade in narcotic drugs, psychotropic substances or precursors in accordance with the provisions of the Act of 29.7.2005 on counteracting drug addiction (ie Journal of Laws of 2018, item 1030, as amended) in the notein the offer submission for narcotic drugs, psychotropic substances or precursors.

The Ordering Party does not specify in this respect any requirements which the Contractor is obliged to demonstrate in a special way. The fulfillment of the condition will be made on the basis of the statement on meeting the conditions of participation in the proceedings. Contractors who are not subject to the contract can apply for the contractexclusion on art. 24 sec. 1 and par. 5 point 1 and point 8 of the PPL act and meet the conditions for participation in the proceedings. 2. According to art. 22 a para. 1 of the Public Procurement Law, the Contractor may, in order to confirm compliance with the conditions of participation in the proceedings, in appropriate situations and in relation to a specific order, or part of it, rely on technical or professional capacity or financial situation-or economic matters of other entities, regardless of the legal nature of the legal relationship that it has with it.3. The Contractor, which relies on the abilities or situation of other entities, must prove to the Employer that while implementing the order will have the necessary resources of these entities, in particular by presenting the obligation of these entities to give him the necessary resources at his disposal.and the needs of the order.3. Contractors may jointly apply for granting a public order on the principles set out in Article 23 of the Public Procurement Law. 4. Contractors jointly applying for the award of the contract establish a representative to represent them in the proceedings for the award or representation in the proceedings and conclusion of the public procurement contract. 5. Regulations-the contractor applies accordingly to contractors jointly applying for the order. 6. If the offer of contractors jointly applying for the order is selected, the Ordering Party will demand prior to the conclusion of the public procurement contract, the contract governing the cooperation of these Contractors. 7. The Ordering Party calls on the Contractor based on Art. 26 par. 1 of the P actZP to submit documents and statements confirming the circumstances referred to in art. 25 ust. 1 of the PPL Act, indicated in Chapter VI SIWZ. 8. The Awarding Entity will apply in this procedure the procedure specified in art. 24aa section 1 of the Public Procurement Law. 9. The contractor (in accordance with Chapter VII of the ToR) prior to the deadline for submitting bids sends to the e-mail address of the Ordering Party an encrypted statement in forHave a EAT with a qualified electronic signature. Information on the decryption of EAT, the Contractor shall provide in the Offer Form. 10. The Ordering Party requests a deposit for the whole order in the amount of PLN 77 605.00. The amount of the deposit for individual packages has been specified in Annex No. 5 to the Terms of Reference. The bid bond is paid in the manner specified in chapter IX SIWZ. 11. Together with the offer, the Contractor shall submit in forme written: 1) Bid form, 2) Assortment and quantity statement, 3) Power of attorney (if applicable), 4) Commitment based on Art. 22a paragraph 2 Public Procurement Law (if applicable). The offer should be attached to a carrier (eg a CD) an electronic version of an editable assortment of quantity and quantity submitted in writing on the offer.
