All economic operators participating in the procedure (tenderertogether with the DUAE, the declaration on their own responsibility regarding the non-compliance with the provisions of art. 72 and 73 of Law no. 99/2016 (Form III.2.1.a.1).

The economic operators submitting the tender individually or in combination, the subcontractors or the supporting third parties must not be in any of the situations provided for inart. 177, 178 and 180 of Law 99/2016

Way of fulfillment:

- All the economic operators participating in the procedure (bidders, associate bidders, third parties, supporters) will fill in the Single European Procurement Document (DUAE) related to their situation,

- At the request of the contracting entity, to confirm the requirement, the tenderer ranked first afterthe application of the award criterion on admissible tenders will present updated supporting documents demonstrating the assumption by completing the DUAE, as follows:

- For Romanian legal / natural persons:

2.a) Establishment certificates regarding the lack of debts regarding the payment of taxes, taxes or contributions to the consolidated general budget (local budget, state budget, etc.).) 2.b) The judicial record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of the persons having the power of representation, decision or control within it, so as evidenced by the certifying certificate issued by the ONRC / instrument of incorporation; 2.c) Where appropriate, documents demonstratingthe fact that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Law no. - 2.d) Other editorial documents, as appropriate,

2.e) Any documents considered as edifying in the country of origin or in the country in which they are established, respectively certificates, likejudicial or other equivalent documents issued by the competent authorities of that country, accompanied by a translation in Romanian. 3:

Participating economic operators must be legally constituted and registered in accordance with the legal provisions of their country of residence, they must not be in any of the situations of cancellation of establishment and musthas the professional capacity to perform the activities that are subject to the contract.

2) Financial support If the tenderer demonstrates its economic and financial capacity by invoking the support granted by to one or more third parties, then the tenderer has the obligation to prove to the contracting entity that he has taken all the measuresit is necessary to have access to the necessary resources at any time by presenting a commitment from the third party / third parties. With the support commitment, the tenderer has the obligation to submit documents sent to him / her by third party / third party supporters, showing the effective way by which the third party / third party (s) will ensure the fulfillment of his / her own commitment(1) The economic operators participating in the procedure must have an average turnover for the last 3 years (2015, 2016, 2017) of at least 4 000 000 RON. ) The Single European Procurement Document (DUAE) can be accessed by interested economic operators at: https://ec.europa.eu/growth/tools-databases/espd/filter.

DUAE completed by the contracting entity and uploaded in SEAP in ".xml" format together with the awarding documentation (signed with electronic signature) can be viewed after saving them on their own computer After saving, go to the European Commission's online service https://ec.europa.eu/growth/tools-databases/espd/filter, tick "I am"Import DUAE", import the DUAE saved on your own computer, select the country and then fill in the form by accessing the "Next" option within each window. The completed information will be checked by the economic operator by pressing the button "Print" that will allow you to view all content. The document will be saved on-computer by accessing the "Export" command and choosing the "Save as" option by selecting the location where it will be stored, generating a ".xml" file with the generic name "espd-request.xml" that can be renamed with the extension ".xml". The ".xml" file will be signed with the electronic signature and will be uploaded to the SEAP similar to the other docs2) According to the provisions of art. 22 par. (7) of H.G. 394/2016, if there is a discrepancy between the information provided in the DUAE and the information provided in the announcement of participation, the information in the announcement prevails, DUAE being revised accordingly; 3a) Submitting any requests for clarification by the economic operators will be made via SEAP, according to ANAP Notification no. 247 / 6.9.2016, available at: http://anap.gov.ro/web/notification-with-privire-to-modality-of-receiving-a-solarists-of-clarifications-prin-intermediate-seap/ ;

3b) The answers to the clarification requests will be attached to the participation announcement (simplified). These responses will be part of the awarding documentation and it is mandatory-4) If two or more bids are ranked first with equal scores, the tie will be made taking into account the score obtained by the rating factors in the descending order of their weight .
