Acquisition of "Milk, Dairy and Cheese" at the units under the responsibility of D.G.A.S.P.C. Alba

Acquisition of "Milk, dairy products and cheese" at the units subordinated to D.G.A.S.P.C. Alba. Description in accordance with the specification and its annexes.
Main Site: Main place of supply: at the headquarters of the DGASPC Alba units, according to the notebook Milk and dairy supply framework agreement at the units under the DGASPC Alba For the supply of milk and dairy products to the sub-units within the General Directorate for Social Assistance and Child Protection Alba it is necessary to conclude a framework agreement / each batch, for a period of 12 months with an economic operator supplying Milk and pThe public procurement framework agreement will be concluded for a period of 12 months with the possibility of modification according to art. 221 par. (1), (2) of Law no. 98 / 2016.
Tenderers, third parties and subcontractors should not be in the situations provided for in art. 60, art. 164, art. 165, art. 167 of the Law no. 98/2016 on public procurement. Only DUAE will be filled into the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the first ranked bidder in the intermediate rankings drawn up at the completion of the tender evaluation. These are:
- Certificates(local budget, state budget) valid at the time of submission of the document, in a copy corresponding to its original or original. Non-resident economic operators (foreigners) have the right to present any enlightening documents to demonstrate that they have fulfilledobligations to pay taxes, taxes and contributions to the state budget in accordance with the requirements of the contracting authority issued by the competent authorities of the country of origin (such as certificates, tax records or other equivalent documents). In case of association, the documents will be presented by each associate individually. Tenders submitted by eco operatorsnominees with unpaid overdue debts to the consolidated general budget will be rejected, - the judicial record of the economic operator and of each member of the administrative, management or supervisory body of the economic operator under the law or those having the power representation, decision-making or control within it, as it resultsa of the certifying certificate issued by the ONRC / constitutive act,
- Other editorial documents, as the case may be.
Pursuant to art. 63 par. (1) of the Law no. 98/2016 regarding the public acquisitions, in order to avoid the bidder in the situation of a conflict of interests, the list of persons with decision-making functions related to the award procedure, as well as the others onmembers of the contracting entity that may influence the content of the procurement documents and / or the performance of the award procedure, as defined by art. 3 lit. I) of the Law no. 98/2016 on public procurement.
Declaration on non-compliance with the provisions of art. 60 of Law no. 98/2016 will be presented, with the completion of the DUAE, by all operators participating in the procedure.The persons holding decision-making positions within the contracting authority:

Foreign legal / natural persons, mandatory requirement: documents proving a form of accreditation from a professional point of view (translatoris authorized, carried out by a person according to Law no. 178/1997).
The economic operator must be registered in the SEAP compulsory, according to art. 104 of GD no. 395 / 2016.
In the case of first ranked offers with equal prices, SEAP will be requested to be re-listed.
