Supply of manganese steel spare parts and hardened milling plates, according to the requirements of the specification no. 18581 / 20.12.2019.

The minimum and maximum value of the framework agreement and the subsequent ones can be found in Annex B „LotuThe bidders, the third party supporters and the subcontractors must not find themselves in the situations provided for in articles 177, 178, 180 of Law no. 99/2016. to the economic operators participating in the award procedure with the information related to their situation.the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting entity, only by the first 3 bidders ranked first in the intermediate ranking prepared at the end of the evaluation of the bids. These documents are:

1) certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the budgetnon-consolidated (local budget, state budget, etc.) at the time of presentation;

2) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator, as it results from the certifying certificate issued by ONRC / the constitutive act;

3) as the case may be, documents proving that the economic operator can benefittax exemption provided for in art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 on public procurement;

4) other edifying documents, as the case may be.

Note 1. For the foreign persons the provisions of art. 181 of Law no. 99 / 2016.

The economic operators who submit a tender must prove a form of registration in accordance with the law of the resident country, from which it can be seen that opthe economic error is legally constituted, that it is not in any of the situations of cancellation of the constitution, as well as the fact that it has the professional capacity to carry out the activities that are the subject of the sectoral procurement contract (to have the main / secondary activities within it correspond to the object acquisition). The requirement also applies to subcontractors and / or third partiessupporters who complete the information related to their situation, at the level of a distinct DUAE. The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by the ONRC or in the case of the foreign bidders, equivalent documents issued in the country of residence, will be presented, at the request of the contracting entity, only by therimii 3 bidders ranked first in the intermediate ranking drawn up at the end of the evaluation of bids.

(a) According to the provisions of art. 202 of Law 99/2016, the contracting authority will accept within the DUAE (Single European Acquisition Document) tenders instead of the requested documents in order to prove the qualification requirements, as a preliminary proof. The economic operator will complete the DUAE with all the requested information,

(b) The requests for clarification of the potential bidders will be addressed exclusively in the SICAP section "Questions" in the procedure of attribution carried out by electronic means, and the answers to these will be published in SICAP, in the section "Documentatie and Clarifications "within the participation announcement, the contracting entity will not respond to the requests addressed by another communication method than the one established in accordance with the provisions of article 78 paragraph (1) of Law no. 99/2016 for the post-submission communications.

The evaluation commission will send the clarification requests regarding the submitted offers, in SICAP lof the "Questions" section. The economic operators will send the answers to clarifications and any documents requested during the evaluation of the offers through the SICAP ("Questions" section), in full in the section corresponding to the respective request, in the form of one or more distinct documents / files signed with electronic signature,

(c) The evaluation of the offers is made prin comparing the prices presented in the admissible offers, being prepared in the ascending order of the respective prices, the ranking based on which the winning bid is established. If it is found that the offers ranked on the first place have equal prices, the contracting entity will request clarifications through SICAP, with a view to electronic uploading by the economic operators of doccurrences containing new prices (new offer forms),

(d) Before awarding the framework agreement, the contracting entity will request the first 3 bidders ranked first after applying the award criterion, to present the updated supporting documents to demonstrate the fulfillment all the qualification criteria, according to the information contained in the DUAE. DUAEwill be deposited, as the case may be, by the third party supporter. In the case of foreign economic operators, equivalent documents issued in accordance with the law applicable in the country of residence will be presented.
