Servicing of carburizing and slagging technological equipment at EC Pruszkow

The subject of the contract is the performance by the Contractor of services for the Employer involving the operation of equipment and installations of carburizing and slagging together with ash removal from boilers, ash tanks and water boiler reagents, unloading of coal wagonsm and servicing the slag crane and coal heap at the premises of the EC Żerań and Sources Local Pruszk-w Manufacturing Department in Pruszk-w (ul. Waryńskiego 1, 05-800 Pruszkow), according to the schedule being Annex 1 to the contract.

Main Site: Zakład EC Żerań and Local Sources Pruszk-w Manufacturing Department in Pruszk-w, ul. Waryńskiego 1, 05-800 Pruszkow, POLAND.

The subject of the order is realby the Contractor for the Employer of services consisting in the operation of equipment and installations for carburizing and slagging together with ash removal from boilers, ash tanks and reagents of water boilers, unloading of coal wagons as well as servicing of a slag crane and a coal heap at the EC Żerań Plant and Local Pruszk-w Production Department in Pruszk-w.

Detailed description of the object of the contractand a was included in the template of the contract 20DOZZ101 constituting Annex 4 to the Instructions for Contractors. grounds for exclusion under Article 24 paragraph 5 point 1 of the Act.

1. Contractors are excluded from the proceedings who:

- have not demonstrated compliance with the conditions for participation in the procedure, or have not demonstrated the absence of grounds for exclusion,

- being a natural person who has been validly convicted of an offense:

a) referred to in - Art. 165a, art. 181 188, art. 189a, art. 218 221, art. 228 230a, art. 250a, art. 258 or art. 270 309 of the Act of June 6, 1997 Penal Code (Dz.AT. Pos. 553, later as amended) or - art. 46 or art. 48 of the Act of 25 June 2010 on sport (Journal of Laws of 2016, item 176);

b) of a terrorist nature referred to in art. 115 - 20 of the Act of June 6, 1997 Penal Code;

c) tax;

- if an active member of his management or supervisory body, a partner in a public or partner company, or a general partner in a koman companyof a limited liability or limited joint-stock partnership or a commercial proxy, has been validly convicted of an offense referred to in art. 24 paragraph 1 point 13 (excluding the conviction of that person for an offense specified in Article 24 (1) (13) (d) of the Act, Article 133 (4) of the Act),

- for which a final court judgment or final administrative decision on arrears has been issued taxes, fees or insurance premiumssocial or health care, unless the Contractor has made the payment of taxes, fees or social security or health insurance contributions due, together with interest or fines, or has entered into a binding agreement on the repayment of these claims, which - as a result of intentional act or gross negligence, introduced the Purchaser into error in providing information that is not subject to exclusionu, meets the conditions for participation in the proceedings or objective and non-discriminatory criteria, hereinafter referred to as "selection criteria", or who has hidden this information or is unable to provide the required documents,

- who, as a result of recklessness or negligence, provided information that mislead the Employer, which may have a significant impact on the decisions taken by the Employer in the proceedingsContract award, which illegally influenced or attempted to influence the Employer`s activities or obtain confidential information that could give him an advantage in the contract award procedure, on the basis of a mandate contract, work contract, agency contract or other benefit contractno services, took part in the preparation of such proceedings, unless the distortion of competition caused by this can be eliminated in a different way than by excluding the Contractor from participation in the proceedings,

- who with other Contractors concluded an agreement aimed at distorting competition between Contractors in the award procedure orders, which the Employer is able to demonstrate using one hundredlegal means of evidence,

- being a collective entity, against which the court ruled a prohibition to apply for public procurement pursuant to the Act of 28 October 2002 on liability of collective entities for offenses under pain of punishment,

- for which a preventive measure was imposed competing for public contracts,

- Contractors who belong to the samecapital group, within the meaning of the Act within the meaning of the Act of 16 February 2007 on competition and consumer protection, submitted separate offers, partial offers or requests to participate in the procedure, unless they show that existing connections between them do not lead to disruption competition in the procurement procedure,

- in relation to which the liquidation was opened.

Willbased on art. 24aa section 1 of the Public Procurement Law, may first evaluate the offers and then examine whether the Contractor whose offer has been assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure.

The offer, eat and attachments to the offer should be made and submitted in pain electronic form with a qualified signature elektronic on the internet platform at https://termika.eb2b.com.pl/. All documents drawn up in a foreign language must be submitted together with their translations into Polish.

The offer and attachments must be signed by the person (s) authorized to represent the Contractor. The authorization (power of attorney) to sign the offer should be attached to the offer, unless it results from othersof documents attached by the Contractor.

By submitting his tender, the Contractor accepts in full and without reservation the terms of the contract set out in the Specification of the Essential Terms of the Contract (hereinafter referred to as "Terms of Reference") together with all attachments constituting its integral part.

In order to pre-confirm that the Contractor is not subject to exclusion and meets the conditions for participation inproceedings, the Contractor attaches to the offer a current statement as at the date of submitting the offers in the form of a single document available in editable form and in the file 20DOZZ101-espd-request.xml posted on the website https://termika.eb2b.com.pl/ in the "Attachments" tab, in accordance with the template of the standard form set out in the European Commission implementing regulation issued on the basis ofknows art. 59 clause 2 of Directive 20 14/24 / EU and art. 80 clause 3 of Directive 2014/25 / EU.9.5.

The contractor who relies on the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them, to the extent that he refers to their resources, the conditions for participation in the proceedings, submits also uniform documents regarding these entities.

In case of joint applicationę about the contract by Contractors, a single document is submitted by each of the Contractors jointly applying for the contract. These documents confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure and the lack of grounds for exclusion.

The Employer convenes a meeting of Contractors (localall future works), which will take place on 15.04.2020 at the CHP Pruszkow in Pruszk-w at ul. Waryński 1. Meeting at 10.00 at the porter`s lodge. Participation in the local vision is not mandatory. Contractor by 14/04/2020 to 12.00 will send the Employer by e-mail to the following address Przemysłlaw.grabowski@termika.pgnig.pl a list of people who will take part in the local vision ofproviding names and numbers of ID cards or passports (regarding foreign citizens). For organizational reasons, the Employer asks each Contractor to delegate up to 3 persons
