The subject of the order is the Contractor's implementation of services consisting in unloading coal and feeding coal for production by the Contractor, adequately to the current needs of the Employer, and the implementation of work related tocleanliness in the Support Area, ie the areas of coal and ash removal, in the Siekierki Heat and Power Plant, according to the schedule of estimated maximum demand for works, constituting Annex 1 to contract 19DOZZ216, based on orders submitted in monthly settlement periods, confirming the scope of current needs Ordering Party.

The subject of the orders is the Contractor's performance of the services consisting in the unloading of coal and the supply of coal for production, adequately to the current needs of the Employer, and the implementation of work related to maintaining cleanliness in the Support Area, ie the areas Carburization and ash removal, on the territory of ElektrocieSiekierki Siekierki, according to the schedule of estimated maximum demand for works, constituting Annex No. 1 to contract 19DOZZ216, based on orders submitted in monthly billing periods, confirming the scope of the Employer's current needs.

The Contractor shall provide the Ordering Party with a copy of the relevant register or central records at his request and business informationbusiness, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act

1. Contractors are excluded from the proceedings who: - have not demonstrated fulfillment of the conditions for participation in the proceedings, or have not demonstrated no grounds for exclusion, - a contractor who is a natural person who has been convicted forDismissal:

a) referred to in art. 165a, art. 181 188, art. 189a, art. 218 221, art. 228 230a, art. 250a, art. 258 or art. 270, 309 of the Act of June 6, 1997. The Criminal Code (Journal of Laws, item 553, as amended) or Article 46 or art. 48 of the Act of 25.6.2010 on Sport (Journal of Laws of 2016, item 176),

b) of a terrorist character, referred to in art. 115 - 20 of the Act of June 6, 1997. Penal Code,

c)treasury, - if a member of its management or supervisory body, a partner of a company in a registered partnership or partnership or a general partner in a limited partnership or limited joint-stock partnership or proxy, has been convicted of an offense referred to in art. 24 sec. 1 point 13 (excluding the conviction of this person for the offense listed in Article 24 (1) (13) d of the Act Art.133 ust. 4 of the Act), - against which a final court judgment or final administrative decision has been issued on the payment of taxes, fees or social security or health insurance premiums, unless the Contractor has made payments of taxes, fees or social security or health insurance contributions with interest. fines or have a binding repayment agreementthose receivables - which - as a result of deliberate action or gross negligence - mislead the Customer in providing information that he is not subject to exclusion, meets the conditions for participation in the proceedings or objective and non-discriminatory criteria, hereinafter referred to as "selection criteria", or who concealed the information or is unable to provide the required documents, - which - as a result of lreckless or carelessness presented misleading information ordering, which may have a significant impact on the decisions made by the Ordering Party in the procurement procedure, - which unlawfully influenced or attempted to influence the Employer's actions or obtain confidential information that could give him an advantage in the procurement procedure,

- who participated in the preparationthe contract award procedure or the employee, as well as the person performing work on the basis of a mandate contract, contractor, agency or other contract for the provision of services, took part in the preparation of such proceedings, unless the resulting distortion of competition can be eliminated in a different way than by exclusion of the Contractor from participation in the proceedings, - which - with other Contractorami has concluded an agreement aimed at distorting competition between Contractors in the proceedings for the award of the contract, which the Purchaser is able to demonstrate by means of appropriate evidence, - a collective entity, for which the court has ruled that it is prohibited to apply for public orders, as a preventive measure, the ban on applying for public orders,

- Contractors who, in the same capital group, submitted separate offers, offers, unless they show that the interconnections between them do not lead to distortion of competition in the procurement procedure, - in relation to which the liquidation was opened or whose bankruptcy was announced, with the exception of the Contractor who, after the declaration of bankruptcy, concluded an arrangement approved by a legally binding decision• Contractors who are in an economic or financial situation can apply for granting the order, i.e. they will show an average annual income of at least PLN 500, 000 for the last 3 financial years, and if the period of activity is shorter then such revenue annual average for this period.

The average annual income from the Contractor will be shown on the basis of "Profit accountand "losses" of part of the financial statements (item "Net revenues from the sale of products, goods and materials" or "Net revenue from sales and related to them") or in the case of Contractors not obliged to prepare the aforementioned documents, other documents defining turnover and liabilities. Revenue is the sum of revenues from the last 3 financial years divided by 3, and ifthe period of conducting business is shorter, the average annual income is the sum of revenues from this period divided by the number of years corresponding to this period. If the income is given in foreign currencies, the Employer will recalculate them according to the average NBP rate of Table A announced on the day the invitation to publish was sent for publication in the Official Journal of the European Union. INIf the exchange rate of this currency by the National Bank of Poland is not published on the day referred to above, the Employer will apply the average exchange rate of the currency recently announced by the National Bank of Poland before the abovementioned date. 24aa paragraph 1 of the Public Procurement Law, may first evaluate the offers, and then examine whether the contractor whose offer was assessed as the most advantageousa, is not subject to exclusion and meets the conditions for participation in the proceedings.

The Contracting Authority has set a shortened deadline for submitting bids 15 days on the basis of art. 43 par. 2b point 2) of the Public Procurement Law, due to the fact that there is an urgent need to award the contract and shorten the deadline for submitting offers is justified. In the previously conducted proceedings, no offer was made and a necessity was madethe beginning of the service of devices and installations starting from 1.8.2019 makes it impossible to carry out the proceedings again within the statutory period. In addition, the shortening of the deadline for submitting bids is justified by the fact that the conditions for participation in the procedure and the scope of the contract did not change significantly compared to those set in part 1 of the annulled procedure 19DOZZ089, whiche was conducted under an open tender procedure in accordance with the Public Procurement Law. The offer, under the pain of nullity, should be prepared in electronic form and submitted via the Bidding Platform at https://termika.eb2b.com.pl/. The offer, together with all attachments, is submitted in electronic form with a qualified electronic signature or a copy certified as compliantwith the original by submitting a qualified electronic signature by the Contractor. All documents prepared in a foreign language must be submitted together with the translations into Polish.

The offer with attachments must be signed (by electronic signature) by the person / s authorized to represent the Contractor. Authorization (power of attorney) to sign the offer should be attached tooffer, unless it is clear from other documents attached by the Contractor.

By submitting your tender, the Contractor accepts in full and without reservation the terms of ordering specified in the Terms of Reference (hereinafter referred to as "SIWZ") with all attachments constituting its integral part.

For preliminary confirmation that the Contractor is not excludedu and meets the conditions for participation in the proceedings, the Contractor encloses to the offer valid as of the date of submission of offers a statement in the form of a single document available in an editable form posted on the Employer's website. Contractor who refers to the resources of other entities in order to demonstrate the lack of existence against them the grounds for exclusion and fulfillment, in so far as it is bindingit lays down on their resources, conditions of participation in the proceedings, submit in an electronic form also uniform documents concerning these entities, signed by the entity to which the documents relate.

In the case of joint application for contractors, the single document shall be submitted in original in the form each of the contractors jointly applying for the order.
