THE MAXIMUM QUANTITIES OF THE FRAMEWORK AGREEMENT AND THE LARGEST SUBSIDENT CONTRACT ARE INTRODUCED IN THE TASK SITUATION AND IN THE TABLE AT THE TENDER PROCUREMENT

The bidders, third parties and subcontractors must not be in situ provided for in Articles 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: COMPLETE DUAE of cthe economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, only by the bidders placed on the first 3 places in the interim ranking made at the completion of the evaluation of the tenders. These documents canfi: a) certificates certifying the lack of overdue debts related to the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation; (b) the criminal record of the economic operator and the members of the administrative, management or supervisory body of that economic operator, or of those having a computerits representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; c) where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; d) other editorial documents after caz. The economic operators submitting the tender must prove a registration form under the law of the country of residence, from which it appears that the economic operator is legally constituted, that it is not find themselves in any of the situations of cancellation of the establishment and the fact that it has the professional capacity to carry out the activities thatare subject to the contract. Modality by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the information related to their situation. For viewing the awarding documentation uploaded in SEAP, economic operators must have a program to view the electronically signed files (this program is available free of charge on the websites of the suppliers hereelectronic nature). In order to tie up any offer with equal prices ranked on one of the top 3 places in the ranking, the contracting authority will ask tenderers who offered the same price a new financial proposal in the form of a clarification in the system, in which case the contract will be awarded to the tenderer whose new proposal the financial price is the lowest. In casewhere the referent is in the second place and presents equal offers as a price, the re-fermentation method does not affect the above-mentioned bidder, respectively the above places, the price can not be improved up to the price offered by the operator ranked on the previous place, respectively the second place in the ranking.
