Frequency of awarding: whenever necessary, daily, weekly.

Invitation to participate (request for tender) to re-offer together with the subsequent tender declared successful and the communication of the result of the procedure constitutes the subsequent valid contract concluded between parties.

Thus, the supporting documents of the subsequent contract will be:

(a) ithe invitation to participate in the re-offer (the request for an offer),

(b) the subsequent offer declared successful,

(c) the communication of the result of the procedure for awarding the subsequent contract which represents and the firm order. Subsequent will be proved by the three documents mentioned above. The moment when the contract was concludedcvent is that of the receipt by the bidder declared successful of the communication regarding the result of the procedure for awarding the subsequent contract (firm orders) of the contracting authority.

Any economic operator has the right to participate in the award procedure as a bidder, individually or jointly. with other economic operators, including in forms of temporary association constapproved for the purpose of participating in the award procedure, proposed subcontractor or supporting third party.

The economic operator (leader, associate, subcontractor, supporting third party, as the case may be) has the obligation to complete and present the DUAE, as the first proof of not being included in the exclusion and of meeting the capacity requirements (according to the DUAE form configured by the contracting authoritydirectly in the SEAP when defining the award documentation). The responses to the DUAE of the economic operator will be completed in SEAP directly, after authentication, by each participant. 164, 165, 167 of Law no. 98/2016

Notes:

A. If the economic operator intends➢ subcontracts part / parts of the contract, DUAE also includes the requested information regarding subcontractors;

B. The DUAE also contains information on the public authority or the third party responsible for drawing up the supporting documents, as well as an official declaration that the economic operator is obliged to provide, on request and without delay, the jurespective statements;

C. In case the contracting authority can obtain the supporting documents directly, by accessing a database, the DUAE also includes the information requested for this purpose, such as the internet address of the database, any identification date and, if applicable, the necessary declaration of consent;

D. If the operatoreconomic demonstrates the fulfillment of the criteria regarding the economic and financial situation or regarding the technical and professional capacity invoking the support of a third party, DUAE includes the information regarding the supporting third party

A. The economic operators participating in the award procedure will complete the DUAE with the information related to their situation;

B. The supporting documents proving indthe fulfillment of those assumed by completing the DUAE will be presented at the request of the contracting authority only by the tenderer whose offer was declared admissible in the intermediate ranking drawn up at the end of the evaluation of the offers according to art. 196 paragraph (2) of Law no. 98/2016;

C. These documents can be:

1) certificates of fiscal certification regarding the payment of taxes, taxes orof the contributions to the general consolidated budget, etc., resulting from the lack of outstanding debts at the time of their presentation; power of representation, decision or control within it, as is clear from certainthe confirmatory liver issued by the ONRC / the constitutive act;

3) as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement;

4) declaration on avoiding the conflict of interests according to art. 60 of Law no. 98/2016, regarding the persons with positionsi of the decision mentioned in the data sheet of the purchase;

5) the fiscal record of the economic operator.

Bidders whose offers will be declared admissible in following the application of the award criterion, it will have the obligation, according to the provisions of art. 132 par. (2) of the GD no. 395/2016, to present the documentsproving to meet the qualification criteria

The contracting authority will conclude the framework agreement with all the bidders submitting declared admissible bids. the contracting authority, during the course of the framework agreement. The maximum TS cannot be exceededand under no circumstances, throughout the framework agreement. The service tariff is an element that can be improved in the re-tendering process for awarding the subsequent contract, the other elements / conditions established initially in the framework agreement not being accepted to undergo modifications.

By the service tariff (TS) offered during the awarding of the agreement -frame means the maximum valueof the commission for the provision of services (booking and issuing of air tickets), which the economic operator will be able to charge for the entire duration of the framework agreement. requested, and if more than one flight ticket is requested through the same invitation to participate in the re-offerre (request for offer), the criterion will be the lowest total price for all the requested air tickets. This price will include all the costs that the contracting authority is going to pay, respectively the actual purchase price of the ticket paid to the airline, the related flight taxes and the service charge (TS) charged by the economic operator. It doesn`t countl at this price any fees for modification / cancellation of the ticket which are the responsibility of the contracting authority.
