The subject of the contract is to provide the distribution service and delivery of high-methane natural gas type E to the property located at ul. Chełmżyńska 9 in Warsaw locatedin the resources of the Military Property Agency of the Regional Department in Warsaw.

The subject of the contract is to ensure the provision of distribution services and the supply of high-methane natural gas type E to the property located at ul. Chełmżyńska 9 in Warsaw, located within the resources of the Military Property Agency of the Regional Department in Warsaw.

1. Provision of distribution servicesshall be used under the conditions specified in the Energy Law of 10.4.1997 (Journal of Laws of 2019, item 42), implementing provisions to this Act and generally applicable legal provisions.

2. The Contractor will be obliged to ensure the standard and quality of service of the Employer in accordance with applicable energy law.

3. Settlements for distribution and up tothe gaseous fuel will be based on the current readings of the measuring system.

4. The Contractor undertakes to carry out the procedure for changing the seller of gaseous fuels, in accordance with the Instruction on the Operation and Operation of the Distribution Network (IRiESD) in the scope of the provision and use of gas distribution services, on the basis of a separate power of attorney.

11. Item definitionorders in accordance with the Common Procurement Vocabulary (CPV):

CPV: 09123000-7 natural gas,

CPV: 65200000-5 gas transmission and similar services.

Current license for conducting business activity in the field of trade (sale) of natural gas, issued by the President Energy Regulatory Office, in accordance with the requirements of the Energy Law of 10.4.1997 (i.e. Journal of Laws of 2019, item 755 as amended) inuntil at least until 31/12/2021

Current license to conduct business activities in the field of natural gas distribution, issued by the President of the Energy Regulatory Office in accordance with the requirements of the Act of 10.4.1997 Energy Law (i.e. Journal of Laws of 2019 item 755 as amended), valid until at least December 31, 2013 for the Contractor who owns the distribution network

Or

Contractand the general one with the Distribution System Operator (DSO) for the provision of natural gas distribution services in the area where the place of natural gas delivery is valid, valid until at least 31.12.2021 in the case of a Contractor who is not the owner of the distribution network

1. In accordance with art. 13 section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 infor the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general regulation on data protection) (OJ L 119, 4.5.2016, p. 1), hereinafter "GDPR", I would like to inform you that:

1) the administrator of your personal data is Agencja Mienia Wojskowego with headquarters at 26 A Nowowiejska Street, 00-911 Warsaw, POLSKA;

2) The administrator has appointed a Data Protection Officer with whom you can contact in matters related to data protection by e-mail to the following address: iod@amw.com.pl or by post to the address of Agencja Mienia Wojskowego, ul. Nowowiejska 26A, 00-911 Warsaw, POLAND, with the note "Data Protection Inspector;

3) your personal data will be processed on the basis of art. 6 clause 1 Lit. GDPR for the purpose related to the procedure for the award of a public contract;

4) recipients of your personal data will be persons or entities to whom documentation of the procedure based on art. 8 and art. 96 section 3 of the Act of 29.1.2004 Public Procurement Law (i.e., Journal of Laws of 2018, item 1986, as amended), hereinafter "Pzp Act";

5) Your personal data will be storede, in accordance with art. 97 paragraph 1 of the Public Procurement Law, for a period of 4 years from the date of termination of the contract award procedure, and in the case of the content of the contract for a period of 10 years or longer in the case of a contract concluded for a period of more than 10 years, then for the duration of it;

6) the obligation to provide by you / your personal data directly concerning you is a statutory requirement specified in the provisions of Act Pzp related to participation in the public procurement procedure; the consequences of not providing specific data result from the Public Procurement Law;

7) with respect to your personal data, decisions will not be taken in an automated manner, applying to art. 22 GDPR;

8) you have:

1. based on Article. 15 GDPR, the right to access your personal data regarding you;

2. based on Article.16 GDPR, the right to rectify your personal data (exercising the right to rectification may not result in a change in the outcome of the public procurement procedure or a change in the provisions of the contract to the extent that it is incompatible with the Public Procurement Law and may not violate the integrity of the protocol and its annexes);

3. based on Article. 18 GDPR the right to request the administrator to limit processingpersonal data subject to the cases referred to in art. 18 clause 2 GDPR (the right to restrict processing does not apply to storage, to ensure the use of legal protection measures or to protect the rights of another natural or legal person, or for important reasons of public interest of the European Union or a Member State);

4. right to vsubmit a complaint to the President of the Office for Personal Data Protection, if you think that the processing of your personal data violates the provisions of the GDPR;

9) you are not entitled to:

a. in connection with art. 17 clause 3 lit. b, d or e GDPR, the right to delete personal data;

b. the right to transfer personal data referred to in art. 20 GDPR;

c. based on Article. 21 GDPR, the right to object topersonal data processing, as the legal basis for the processing of your personal data is art. 6 clause 1 lit. c GDPR.
