1. The subject of the contract is a comprehensive supply - including the sale and provision of distribution services - high-methane natural gas with the symbol E in the period from 1.1.2020 to31.12.2020, with a total forecast volume of 214.212.880 kWh to 524 collection points.

The subject of the order is the supply of high-methane natural gas through the distribution network of Polska Społki Gazownictwa Sp. z o.o. on quality standards set forth in accordance with applicable regulations, including transmission service.

Deliveries and distribution servicesdelivered on the basis of a comprehensive agreement, they will be carried out under the conditions set out in the Act of 10.4.1997 Energy Law and executive regulations to the Act, and in accordance with the provisions of the DSO Tariff.

The quality parameters of gaseous fuels are regulated by the provisions of the Energy Law, executive acts in particular the Minister Economy of 2.7.2010 regarding detailsconditions for the functioning of the gas system and the Ordinance of the Minister of Energy of 21.9.2018 amending the ordinance on detailed conditions for the functioning of the gas system and Polish standards. distribution of gas fuels issued pby the president of the Energy Regulatory Office. The Awarding Entity will consider the condition fulfilled if the Contractor has a valid:

a) a license for trading in gaseous fuels issued by the President of the Energy Regulatory Office and

b) a license for the distribution of gas fuels issued by the President of the Energy Regulatory Office or (if the Contractor is not the owner of the network in the area in which it is locatedplace of supply of natural gas) a valid contract with the distribution system operator for the provision of gas fuel distribution services enabling delivery to the collection points described in Annex 1 to the ToR. shall submit:

a) the valid Koa license for trading in gaseous fuels issued by the President of the Energy Regulatory Office, and, natural gas). A statement confirming that the Contractor has a valid contract with OperDistributor of the Distribution System for the provision of gas fuel distribution services in the area where the natural gas collection point is located, authorizing the contractor to make deliveries to the collection points described in Annex 1 to the ToR (according to the model constituting Annex 5 to the ToR).

Condition of participation the Contractor is in possession of civil liability insurancein the scope of conducted activities related to the subject of the contract for a guarantee sum of not less than PLN 5, 000, 000.00 (five million PLN 00/100).

The Ordering Party shall deem the condition fulfilled if the Contractor demonstrates possession of civil liability insurance in the scope of with the subject of the order for a guarantee sum of not less than 5, 000, 000.00PLN (five million 00/100 zlotys).

1. Contractors who are not subject to exclusion from the procedure may apply for the order.

2. The Employer will exclude from the proceedings the Contractor: who has not demonstrated compliance with the conditions for participation in the procedure or has not demonstrated the absence of grounds for exclusion, subject to exclusion pursuant to art. 24 paragraph 1 of the PPL Act, subject to exclusion on the basis ofArt. 24 paragraph 5 item 1, item 4, item 8 of the PPL Act

3. In order to confirm the lack of grounds for excluding the Contractor from participation in the procedure - the Employer (based on the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in the procurement procedure OJ 2016 item 1126 as amended) requests the following documents:

1) information fromNational Criminal Register in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the PPL Act issued not earlier than 6 months before the deadline for submission of bids;

2) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with tax payment, issued not earlier than 3 (three) months before the expiry of deadline for submitting offers or other documentntu confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments as provided for by law or withholding in full the execution of the decision of the competent authority;

3) certificate competent field organizational unitSocial Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 (three) months before the deadline for submitting offers or other document confirming that the Contractor has concluded an agreement with the competent authority on repayments youtheir receivables, together with any interest or fines, in particular, obtained by law exemption, deferment or spreading in installments of overdue payments or withholding in full the decision of the competent authority;

4) an excerpt from the relevant register or from the central register and information on business activity, if separate provisions require an entry in the register or register, into confirm the absence of grounds for exclusion under Article 24 paragraph 5 point 1 of the Public Procurement Law;

5) the Contractor`s statement that he has not issued a final court judgment against him or a final administrative decision on arrears in the payment of taxes, fees or social security or health insurance contributions, or in the case of such a judgment or decision of documents confirmingpayment of these receivables together with any interest or fines or conclusion of a binding agreement on the repayment of these receivables - according to the template constituting Annex 8 to the ToR;

6) the Contractor`s statement that there was no decision against him as a preventive measure prohibiting him from applying for public procurement - according to the formula constituting Annex 8 to the ToR;

7) the Contractor`s declaration of independencelegalizing the payment of local taxes and fees, referred to in the Act of 12.1.1991 on local taxes and fees (Journal of Laws of 2016, item 716); - according to the template constituting Annex 8 to the ToR

8) the Contractor`s statement on belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the Public Procurement Law (according to the model constituting Annex 7 to the ToR), and in the case of belonging to the same capital group, the Contractor may submit together with a statement documents or information confirming that links with another Contractor do not lead to distortion of competition in the proceedings.

4. The procedure is conducted in an open tender.

5. The contracting authority envisages the possibility of using the "reversed procedure", in accordance with Article 24aa of the Public Procurement Law
