Natural Gas Supply Framework Agreement

Framework Agreement for Supply of Natural Gas for a Period of 12 Months

Main Site: S.C.J.U. Sibiu - Natural gas is used by the contracting authority for: - heating, - food preparation, - hot water - The purpose of this procedure is to purchase natural gas from any suppliernatural gas supply, issued by ANRE, operating on the free market, at negotiated tariffs lower than those on the regulated market, so as to reduce natural gas expenses by concluding a framework agreement for supply in economically advantageous conditions.

The value of the largest subsequent contract concluded half-yearly, is 445 565, 06 RON.non-compliance with Art. 164 of Law 98 / 2016.

The economic operator (individual bidder, member of an association, subcontractor, third-party supporter) or any person who is a member of the board of directors / management, representation, decision-making or control within it is not in any of the situationsreferred to in art. 164 par. (1) of the Law no. 98/2016, on grounds of exclusion regarding criminal convictions; 2) Statement according to art. 165 of Law 98/2016.

The economic operator (individual bidder, member of an association, subcontractor, third party advocate) is not in any of the situations mentioned in art. 165 par. (1) and par. (2) of the Law no. 98/2016, privind reasons for exclusion regarding the payment of taxes or social security contributions; 3) Statement regarding non-compliance with art. 167 of Law 98 / 2016.

The bidder (individual bidder, member of an association, subcontractor, third party advocate) is not in any of the situations mentioned in art. 167 par. (1) of the Law no. 98/2016, on the grounds for exclusion referinsolvency proceedings, conflicts of interest or professional misconduct. These may be: - reasons for exclusion on insolvency / liquidation, - - reasons for exclusion of conflicts of interest or serious professional misconduct, - reasons for exclusion of distortions of competition, - reasons for exclusion on early termination of contracts, payment of damages or other sanctionsand comparable; 4) Statement of Non-compliance in Art. 60 of Law 98/2016 The economic operator (individual bidder, member of an association, subcontractor, third party advocate) declares that it is not in potentially conflicting situations or any other situation that could lead to a conflict of interests, with the staff of the contracting authorityor a supplier of procurement services acting on behalf of the contracting authority which are involved in the conduct of the award procedure or which may influence the outcome thereof have, directly or indirectly, a financial, economic or other personal interest which could be perceived as an element that compromises their impartiality or independence in the context of paward procedure

The way to demonstrate the fulfillment of the requirements: It will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted at the request of the contracting authority only by the tendererfirst placed in the intermediate rankings drawn up at the completion of the tender evaluation together with the Declarations 164, 165 167. The declaration 60 will be loaded with the DUAE and the participation guarantee.

These documents may be: - - tax certification certificates regarding the payment of the obligations due at the general consolidated budget and the local budget, which shows the lack of overdue debts at the momentof loading the offer to SICAP, according to the provisions of Law no. 227/2015 regarding the Fiscal Code, - the criminal record of the economic operator and of the members of the management, management or supervisory body of the economic operator or of the persons having the power of representation, decision or control within it, as it results from the certifying certificate issued by ONRC /the constitutive document, - where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement, - other editing documents, as appropriate.

If two shave several offers ranked first, then, in order to conclude the framework agreement, at the written request of the evaluation committee sent to SICAP, the "Questions" section, will be answered with a new offer or, as the case may be, confirmation that the initial price is maintained. After a new evaluation and application of the award criterion, the bidder who has the pricethe lowest or, in case of equality, until the winner is established, and if no winner can be established, the procedure will be canceled.
