To demonstrate the fulfillment of the criteria / qualification will be presented:

I. The sole bidder / associated bidder / subcontractor / third party must demoteit does not fall within the provisions of art. 177 of Law no. 99/2016. In this respect, the sole bidder / associated bidder / subcontractor / third party will complete the DUAE - Part III "Exclusion Reasons", Section A "Reasons for Criminal Offenses". The bidder ranked first in the intermediate rankings completed at the evaluation of the bids, will present, upon requestcontracting entities, the following editorial documents proving / confirming non-compliance with the situations provided in art. 177 above, both for the sole tenderer / associated bidder and for the subcontractor / third party stated in the offer:

- the criminal record of the economic operator and of the members of the management, management or supervisory body of that personeconomic operator or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; other editing documents, as appropriate;

II. The sole tenderer / associated offeror / subcontractor / third party must prove that they do not comply with the provisions of art. 178 of the Law no. 99/2016. In this regard, the sole bidder / associated offeror / subcontractor / third party will complete the DUAE - Part III "Exclusion Reasons", Section B "Reasons for Paying Taxes or Contributions to Social Insurance". Also, the tenderer ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders, shall present, at the request of the contracting entity, the followingevidencing evidences proving / confirming non-compliance in the situations provided by art. 178 above, both for the sole offeror / associated bidder and for the subcontractor / third party stated in the offer:

A. The Romanian legal persons must submit: - - tax certification certificates regarding the fulfillment of the obligations to pay the taxes, taxes and contributions tothe general consolidated budget and the fulfillment of the obligations to pay the taxes and fees to the local budgets in which the overdue debts at the moment of its presentation will occur; Foreign legal persons shall present any editorial documents issued by the authorized institutions of the country of origin (tax attestations, criminal records, other documentsvalente, etc.) to prove that they have fulfilled their obligations to pay taxes, duties or contributions to the general consolidated budget in accordance with the national law of the country of residence of the sole tenderer / associated contractor / subcontractor / third party; or of the country where the sole vendor / associated offeror / subcontractor / third party is standingThe outcome is;

C. Documents demonstrating that the economic operator may benefit from the derogations provided in art. 179 par. (2) of Law No 99/2016 on Sector Acquisitions (if applicable);

III. The sole tenderer / associated offeror / subcontractor / third party must prove that they do not comply with the provisions of art. 180 of Law no. 99/2016. In this regard, the bidderUnique / Associated bidder / Subcontractor / Supporter third party will complete the DUAE - Part III "Exclusion Reasons", Section C "Insolvency, Conflicts of Interest, or Professional Misconduct" reasons. Moduleequal offers will be made as follows:

1) If it is found that more than 2 admissible offers with equal prices have been deposited / entered into the SICAP, the bidder will send via SICAP, a request for clarification regarding the submission of new improved financial proposals and economic operators will sendtheir reply to the SICAP in electronic form, signed with the extended electronic signature, in which case the contract will be awarded to the first bidder with the lowest price; 2) If it is found that more than 2 admissible tenders have been submitted with equal prices by the second rank bidders, the way they will be allocated will be similar to the above mentioned, so that the first ranked bidder is not affected, ie the new financial proposal will not be equal to or less than the ranked first place. If the new improved financial proposal, following the request of the contracting entity, will influence the ranking of the places higher, this will not be taken into account, keeping in mind the initial offer submitted to the SICAP atEdur. The same procedure is followed. the division of equal in the following case. (a) the contracting entity has the right to request the tenderers, in exceptional circumstances, before the expiration of the period of validity of the offer, the extension of that period, (b) the tenderer has the obligation to communicate to the contracting entities if it is; does not agree with the prolongation. valid(c) the bidder who does not agree with the lengthening of the lender. of valab. the offer and the guarantee of participation. (d) the clarification requests of potential bidders will be exclusively addressed to the SICAP in the dedicated section of the award procedure.and the responses to them will be published in the SICAP, the contracting entity will not respond to the requests addressed by another means of communication than the one established in accordance with the provisions of art. 78 of Law 99/2016 for subsequent posting of tenders. The Evaluation Committee will forward requests for clarification of bids. DThe economic operators will send the answers to the clarifications and any documents requested during the evaluation of the tenders through the SICAP, fully in the section corresponding to the respective request, in the form of one or more documents / separate files signed with extended electronic signature,
