Acquisition of Motor Third Party Liability Insurance for Motor Vehicles within the General Directorate for Internal Protection (DGPI) for damage caused to third parties by accidents, as required by the Terms of Reference.

Main Site: Service Provisionshall be performed at the headquarters of the contracting authority in Bucharest, Str. Răzoare nr. 5, sector 6.

Acquisition of Motor Third Party Liability Insurance RCA for Motor Vehicles within the General Directorate for Internal Protection (DGPP) for injuries caused to third parties by accidents, CPV code 66516100-1, according to the requirements of the Tender Specifications. The procedure will be completed by(including, where applicable, all lots and options):

Amount of the framework agreement: at least 11 policies - maximum 1 500 RCA insurance policies, valid for 3 months and respectively 12 months, as follows:

- for 2018 at least 11 policies will be concluded - up to 500 MTPL insurance policies, valid for 3 months,

- for the yearIn 2019, at least 11 policies will be concluded - a maximum of 500 RCA insurance policies with a validity of 12 months, - for the year 2020, at least 11 policies will be concluded - up to 500 MTPL insurance policies valid for 12 months. the larger subsequent contract is at least 11 policies - up to 500 MTPL insurance policies with a validity of 12 months, worth at least RON 10, 240.00-- maximum 364 360, 00 RON.

Requirement no. 1:

Requirement 1 - Declaration of eligibility: tenderers, associates, subcontractors should not find themselves in the situations provided in art. 164 of the Law no. 98/2016. The bidders, third parties, subcontractors will fill in the appropriate requirement in the DUAE form in the award documentation. The framing of the situation stipulated in art. 164 of-Law no. 98/2016 on public procurement leads to the exclusion of the tenderer from the procedure applied for awarding the public procurement contract. Mandatory requirement: The DUAE form will be filled in by the economic operators participating in the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the completed onesDUAE will be submitted, at the request of the contracting authority, only by the tenderers ranked in the first three places in the intermediate rankings drawn up after the evaluation of the tenders, after applying the award criterion, until the conclusion of the award procedure report, 196 par. (2) of the Law no. 98/2016 on public procurement. 2: Statement-regarding non-compliance with the provisions of art. 165 of the Law no. 98/2016: tenderers, associates, subcontractors should not find themselves in the situations provided by art. 165. The bidders, third-party supporters, subcontractors will fill in the appropriate requirement in the DUAE form in the award documentation. The framing of the situation stipulated in art. 165 of Law no. 98/2016 on pub acquisitionslice attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.

The DUAE form will be filled by the economic operators participating in the award procedure, with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented at the request of the authority againstonly by the bidders placed on the first three places, in the intermediate rankings drawn up at the completion of the evaluation of the tenders, after applying the award criterion, until the closing date of the award procedure report, according to art. 196 par. (2) of the Law no. 98/2016 on public procurement. The following documents will be presented:

1) Establishing certificates for debt owed(2) The judicial record of the economic operator and of the members of the organ of the state budget, as well as of the tax authorities, management, management or oversight of that economic operator or those having re-powerpresentation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / constitutive act; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016; 4) Other editing documents, as the case may be.

Requirement no. 3:

Statement on-failure to comply with the provisions of art. 60 of the Law no. 98/2016 (bidders, associations, subcontractors). The bidder must complete and submit Form no. 1.

Mandatory requirements:

Declaration on non-compliance with the provisions of art. 60 of the Law no. 98/2016 (Leader / Independent, Associate, Subcontractor).

By the deadline for submitting bids, economic operators will submit to SEAP the DUAE form, completed at the dedicated address: https://ec.europa.eu/ growth / tools-databases / espd / filter

Tenderers will submit electronically the SEPA technical proposal and financial proposal. In accordance with Art. 193 of Law no. 98/2016, where applicable, the DUAE will include the required information on the Associate and / or Subcontractors. Any amendments to the contract terms in the Project Agreement will be made with the offer. Amendments made after the submission of tenders will not be taken into account. Negotiations of contractual terms that have not been objected to by the initial offer are not admittedthat. In order to view the attribution documentation uploaded in the SEAP, economic operators must have a program required to view the electronically signed files (this program being available free of charge on the websites of the electronic signature providers). Clarifications sent by economic operators on working days after 16.00 or non-working (Saturday, Sunday or holidays)gale) will be recorded by the contracting authority on the next working day. The bidders placed on the first 3 places in the interim ranking after evaluating all the submitted bids, according to the award criterion specified in the tender notice, will have to present the updated supporting documents in order to prove the ones assumed by the DUAE

Note: The winners / signersframe order will be those whose admissible bid is in the top three places in the final standings. Subsequent contracts will be concluded with the economic operator in the 1st place. If the economic operator that is part of the first frame agreement is not able to respond to the requests of the contracting authority, the subsequent contract will be concluded with the following operationeconomic part of the framework agreement.

The way of awarding offers with equal price: considering that the framework agreement ends with a maximum of 3 economic operators, the way of dividing the possible offers with equal prices ranked on one of the first 3 places in the leaderboard will be re-ranking. The referral will be done by electronically loading into the SEAP of the documents containing it-new prices. The reopened price can only be improved up to the price offered by the previous ranked operator. If even after this reconsideration we find equal prices, then the reopening procedure is resumed under the same conditions. If after this reconsolidation equal prices are established, then the purchase procedure is canceled.
