The tenderers, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167, 59, 60 of Law no. 98/2016-regarding public procurement.

1) Non-compliance with the provisions of art. 164 of Law no. 98/2016 on Public Procurement.

The economic operator will fill in the corresponding requirement in the DUAE form in the awarding documentation. Incorporation in the situation stipulated in art. 164 of Law no. 98/2016 on public procurement leads to the exclusion of the bidder from the procedure applied for the award of the contract2) Failure to comply with the provisions of art. 165 of the Public Procurement Law no.98 / 2016.

The economic operator will fill in the corresponding requirement in the DUAE form in the awarding documentation. The economic operator will fill out the appropriate requirement in the DUAE form in the tender documentation. The framing of the situation stipulated in art. 167 of Law no. 98/2016 on public procurement leads to the exclusion of the tenderer from the procedure applied for awarding the contractThe documents justifying the fulfillment of the assumed by completing the DUAE are to be submitted, at the request of the contracting authority, only by the bidder ranked first after applying the award criterion, until the conclusion of the Award Procedure Report, according to art. . 196 par. (2), art. 171 of Public Procurement Law 98/2016; 4) other edThe non-resident economic operators (foreigners) have the right to present any editorial documents issued by the authorities of the country where they are residents, proving the fulfillment of the obligations to pay the taxes to the state budget and the local budget, in according to the legislation of the country of residence. Documents will be accompanied by their authorized translation into Romanian; 4) Non-compliance with the provisions of art. 59 and art. 60 of Law no. 98/2016 on Public Procurement.

The economic operator will fill in the appropriate requirement in the DUAE form in the awarding documentation andwill submit Form no. 7 with the DUAE until the deadline for submission of the offer. The documents will be signed with the extended electronic signature and will be posted in SEAP.
