3.3. Ordering Party requirements regarding the subject of the order:

1) the medical device offered must have certificates, and be registered in accordance with the legal regulations requiring certificates, and registration,

2) the medical device offered must be placed on the market and used in accordance with the requirements of the Act of 20.5.2010. about medical devices (Journal of Laws of 2017, item 211),

3) the medical device offered must meet the standards ortechnical specifications applicable to this product;

In the event that the medical device offered does not require notification to the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products, the Contractor is obliged to carry out at its own expense all activities necessary to fulfillment of all legal requirements related torunning the product on the market and using it on the territory of the Republic of Poland. The Contractor is obliged to perform such activities within the time limits resulting from the applicable regulations and to provide the Employer within these dates with relevant documents confirming the performance of such activities.

3.4. The contracting authority requires the implementation of the subject of the contract on the terms set out in the contract, the model stipulatesand an attachment to the ToR.

3.5 Pursuant to art. 13 para. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (General data protection) (Official Journal L 119, 4/4/2016, page 1), hereinafter "RODO", pleasethat:

5.1. contractors who:

1) are not subject to exclusion;

2) meet the conditions for participation in the proceedings, if they have been specified by the orderthe applicant in the contract notice or in the invitation to confirm interest.

5.1.1. Contractors applying for the subject of the order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 point 13 and 14 oonce 16-20 Pzp, art. 24 sec. 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove compensation for damage caused by an offense or fiscal offense, financial compensation for damage suffered or remedied, a comprehensive explanation of the facts and cooperation with-law enforcement agencies and taking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court decision prohibiting to apply for the award of the contractand the expiration of the ban specified in that judgment has not expired. - None of the Contractors jointly applying for the award of contracts referred to in art. 23 Pzp, may not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 of the Pzp and art. 24 sec. 5 point 8 PzP.

The Ordering Party will investigate whether the Contractor, whose offer has been assessed as the most advantageous, is not subject to hatchlearning, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp. The Employer defines the following conditions for participation in the proceedings:

1) the condition of competences or entitlements to conduct a specific professional activity, if it results from separate regulations, i.e.: The Ordering Party does not specify the condition of participation in the proceedings in this respect.Contractors jointly applying for the award of contracts referred to in art. 23 PPL, must jointly meet the condition specified in art. 22 ust. 1b item 1 of the Public Procurement Law. Each contractor is obliged to attach:

1 The Contractor's declaration (Uniform European Order Document) present on the day of submitting offers.

- prepared according to the template attached to the Terms of Reference,

- submitted in electronic formThe information included in the statement will constitute preliminary confirmation that the contractor is not subject to exclusion and fulfills the conditions for participation in the proceedings - Representatives of joint bidders and entities making the potential available on the EJSE form in the form of an electronic document should be signed qualificationswith an electronic signature by each of them in the scope in which they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. The same requirement applies to EAT submitted by a subcontractor, pursuant to art. 25a para. 5 point 1 of the Public Procurement Law - In the case of Contractors jointly applying for the award of a contract, this document is submitted by each of the Contractors jointly applying forthe contractor or on behalf of the Contractor submits it to the Contractor;

the Contractor who intends to entrust the execution of a part of the contract to subcontractors, in order to demonstrate the absence of grounds for exclusion from participation in the procedure, submits the statement referred to in this point of the specification for each subcontractor . cd

5.1 The order may be awardedą contractors who are: -1) are not subject to exclusion,

2) meet the conditions for participation in the procedure, if they have been specified by the ordering party

5.1.1. Contractors applying for the subject of the order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec.1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 item 13 and 14 and 16-20 of the PPL, art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove that the damage caused by the crime or fiscal offense has been remedied., financial compensation for damage suffered or compensation for damage, an exhaustive explanation of the facts and cooperation with law enforcement agencies, and taking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence does not apply sŻad if the contractor, being a collective entity, has been the subject of a final court ruling against applying for the order and the period of validity of the prohibition specified in that judgment has not expired. - None of the Contractors jointly applying for the order referred to in Art. 23 Pzp, may not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 Pzp and-Art. 24 sec. 5 point 8 of the Public Procurement Law.

The Contracting Authority will examine whether the Contractor whose tender has been evaluated as the most advantageous is not subject to exclusion, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp. The Ordering Party specifies the following conditions for participation in the proceedings:

1) condition of the economic or financial situation, i.e.: Ordering not specificthe Contractor jointly applying for the order, referred to in Article 23 PPL, must jointly meet the condition specified in art. 22 ust. 1b point 2 of the PzP.

Each contractor is obliged to attach to the offer:

1 The Contractor's statement (Uniform European Order Document), valid as of the day of submitting bids.

- prepared according to the formulaego an attachment to the ToR,

- submitted in electronic form, with a qualified electronic signature.

The information contained in the declaration will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure.

Statements of the entities submitting the offer jointly and entities providing the folded potential on the EAT form that has the form toelectronic document, should be signed by a qualified electronic signature by each of them to the extent that they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. An equivalent requirement applies to EAT submitted by a subcontractor, pursuant to art. 25a para. 5 point 1 of the Public Procurement Law - In the case of Contractors jointly applying for the award of the order, this documentEach Contractor jointly applying for or on behalf of the Contractor shall submit it to the Contractor, - the Contractor who intends to entrust the execution of a part of the contract to subcontractors, in order to demonstrate the absence of grounds for exclusion from participation in the proceedings, submits the statement referred to in this specification point, for each subcontractor.

The Contractor who relies on the resources of other entities in order to demonstrate the absence of grounds for exclusion and fulfillment to them in so far as he relies on their resources, the condition of participation in the proceedings also submits the statement referred to in this point of the specification regarding these entities.

6.2. According to art. 24aa paragraph 1 Pzp. The Contracting Party will first evaluate the offers, andthen examine whether the contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure.

6.3. The ordering party, before granting the order, will call the contractor whose offer has been rated the most, to submit within the prescribed period, not shorter than 10 days, valid as of the date of submission of the following statements or documents:

List-statements or documents confirming no grounds for exclusion of the Contractor from participation in the proceedings - current extract from the relevant register or from central records and business information, if separate regulations require entry in the register or records, in order to demonstrate the absence of grounds for exclusion based on art . 24 sec. 5 point 1 of the Act, - submitted in the form of an original or copyii certified for compliance with the original by the Contractor.

Current information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders,

- submitted in the form of the original or a copy certified for compliance with the original by the Contractor.

Current certificate of the competent office managerarbowego confirming that the contractor is not in arrears with paying taxes, or a certificate that he obtained the lawful exemption, postponement or spreading overdue payments or suspending in full the decision of the competent authority - issued no earlier than 3 months before the deadline for submission of tenders; submitted in the form of the original or a certified copywith the original by the Contractor. - A current certificate from the relevant branch of the Social Insurance Institution or Agricultural Social Insurance Fund confirming that the contractor is not in arrears with payment of social and health insurance premiums, or confirming that he obtained legally required exemption, postponement or payment of overdue payments or suspension in fullthe decision of the competent authority - issued not earlier than 3 months before the deadline for submission of tenders;

- submitted in the form of the original or a copy certified as a true copy by the Contractor.

The Contracting Authority does not plan to provide similar contracts referred to in art. 67 sec. 1 point 6 of the Public Procurement Law - the Employer does not provide for additional orders for supplies referred to in art. 67 sec. 1 point 7 PzP.
