ACCORDING TO THE TENDER PROCEDURE

• • Bidders, third parties and subcontractors must not be foundin the situations stipulated in art. 164, 165, 167 of Law no.98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the AUAE (Unique European Procurement Document) will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE (DocumEuropean Unique Procurement Agreement)

It is to be submitted, at the request of the contracting authority, only by the economic operator ranked first in the order of the ranking in the interim ranking made at the completion of the evaluation of the tenders. These documents can be:

1. certificates of absence of overdue debts in respect of the payment of taxes, duties orthe general consolidated budget (local budget, state budget, etc.) at the time of presentation; the criminal record of the economic operator and the members of the management, management or supervisory body of that economic operator, or those having the power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / act constitutiv;

3. as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; other editing documents, as appropriate.

• Avoiding conflict of interest Law no. 98/2016. Conf. Art. 58-638, the persons holding decision-making positions within the authorscontracting parties are:

Also, the proposed subcontractors must not be in any of thereferred to in art. 164, 165 or 167 of Law no. 98/2016 on Public Procurement.

In the case of an association, each associate (including the leader) is required not to be in any of the situations provided under art. 164, 165 or 167 of Law no. 98/2016 on public procurement. DUAE will be completed by the Associate, subcontractor or third party advocate.

According to art. 60 of the HG395/2016, the economic operators will submit the DUAE (European Unique Acquisition Document) obligatory, and the supporting documents proving the fulfillment of the assumed by completing the DUAE will be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate classification prepared to complete bid evaluation.

Note 1. According to the provisionsArticle 193 of Law 98/2016, the contracting authority will accept the preliminary proof as part of the DUAE (Single European Procurement Document) bids instead of the required documents for the demonstration of the qualification requirements, including the exercise capacity. DUAE can be downloaded for completion and submission at https://ec.europa.eu/growth/toolsdatabases/espd/filter (instructions for completing DUAE are available at www.e-licitatie.ro). Prior to awarding the product contract, the contracting authority will require the economic operator ranked first in the order of the ranking in the intermediate rankings drawn up at the completion of the tender evaluation after application of the award criterion, present the current supporting documentsin order to demonstrate that all the qualification criteria have been met, according to the information contained in the DUAE. DUAE will be submitted, as the case may be, also by the supporting party.

Requirement No.1-General information on the average turnover in the related field(for two or more offers) and ranked first, second or third place, the mode of betting between the offers will be made in function the price of the financial offer. If further scoring is found, tenderers will be required to reopen on the criterion of atriIf the equality of points continues to be maintained, the batches for which equality persists will be canceled.

In case-there are uncertainties or uncertainties regarding the qualification documents, the technical proposal and the financial proposal, the contracting authority reserves the right to request clarification to the economic operators, observing the provisions of art. 92 of Law 98/2016 and art. 134 of H.G. 395 / 2016.
