A detailed description of the subject of the contract is contained in Annex 2b and Annex 5 to the ToR.

3.3. Ordering Party's requirements regarding the subject of the order:

1) the medical device offered must have certificates, and be registered in accordance with the law requiring certificates, and registration,

2) the medical device offered must be entered intomarketing and use in accordance with the requirements of the act of 20.5.2010 on medical devices (OJ of 2015, item 876),

3) the medical device offered must meet technical standards or specifications for the product;

In the event that the medical device offered does not require notification to the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products.ca is obliged to carry out, at its own expense and on its own, all activities necessary to comply with all legal requirements related to placing the product on the market and using it on the territory of the Republic of Poland. The Contractor is obliged to perform such activities within the time limits resulting from the applicable regulations and to provide the Employer with

3.4. The orderer requires realitiesthe subject of the order on the terms specified in the contract, the model of which is an attachment to the SIWZ. - Description of the criteria that the ordering party will be guided when choosing the offer, including the weightings of these criteria and the way of assessing offers

13.1. The evaluation of the offers will be carried out on the basis of the criteria specified in the Terms of Reference and their weights. • The offers will be evaluated point-wise.raffles and evaluated offers are awarded points for the following criteria according to the following rules: - Price criterion weight: 60%

Criterion order execution time weight: 20%

Criterion warranty period weight: 20%

5.1 The contractors can apply for the ordering:

1) are not subject to exclusion,

2) meet the conditions for participation in the proceedings, if they have been specified by the ordering partyannouncement about the order or an invitation to confirm interest.

5.1.1. Contractors applying for the subject of the order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 points 13 and 14 and 16-20 Pzp, art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove compensation for damage caused by a crime or fiscal offense, financial compensation for damage suffered or remedied, a comprehensive explanation of the facts and cooperation with law enforcement agenciesand taking specific technical, organizational and personnel resources that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court decision prohibiting him from applying for the order and not-the period of validity of the ban specified in this judgment expired. None of the Contractors jointly applying for granting orders referred to in art. 23 Pzp, may not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 of the Pzp and art. 24 sec. 5 point 8 PzP.

The Ordering Party will investigate whether the Contractor, whose offer has been assessed as the most advantageous, is not subject to exclusion, inrciu for the required documents and statements and the information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp. The Employer defines the following conditions for participation in the proceedings:

1) the condition of competences or entitlements to conduct a specific professional activity, if it results from separate regulations, i.e .: Ordering does not specify the condition of participation in the proceedings in this respect. et alolnie applying for granting orders, referred to in art. 23 PPL, must jointly meet the condition specified in art. 22 ust. 1b point 1 of the PPL,

6. A list of statements or documents confirming compliance with the conditions of participation in the procedure and no grounds for exclusion, and documents or declarations confirming that the offered deliveries meet the requirements specified by the ordering party

6.1. Each contractor is obliged to attach to the offer:

1 The Contractor's declaration (Uniform European Order Document) valid at the date of submitting offers.

- prepared according to the template attached to the ToR,

- submitted in electronic form, with a qualified electronic signature.

Information contained in the statement will be a preliminary confirmation that the contractor is not subject to

statements of the entities submitting the offer jointly and entities making the potential available on the form JEDZ in the form of an electronic document should be signed with a qualified electronic signature by each of them to the extent that they confirm the circumstances referred to in Article . 22 ust. 1 of the Public Procurement Law. Analogthis requirement applies to EAT submitted by a subcontractor, pursuant to art. 25a para. 5 point 1 of the Public Procurement Law - In the case of Contractors jointly applying for the award of a contract, this document is submitted by each of the Contractors jointly applying for the order or on behalf of the Contractor is filed by that Contractor; - Contractor who intends to entrust the execution of some orders to subcontractors, -in order to demonstrate that there are no grounds for exclusion from participation in the procedure, submit the statement referred to in this point of specification for each subcontractor.

5.1 Contract award may be applied by contractors who:

1) are not subject to exclusion;

2) meet the conditions for participation in the proceedings, if they have been specified by the ordering party in the contract noticeor in the invitation to confirm interest.

5.1.1. Contractors applying for the subject of the order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 item 13 and 14 and 16-20 of the PPL, art. 24 paragraph 5 points-1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove compensation for damage caused by an offense or fiscal offense, financial compensation for damage suffered or remedied, an exhaustive explanation of the facts and cooperation with law enforcement agencies and takingspecific technical, organizational and human resources that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court decision prohibiting him from applying for the order and has not expiredin this judgment, the period of this prohibition. - None of the Contractors jointly applying for granting orders referred to in art. 23 of the PPL, it can not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 of the Pzp and art. 24 sec. 5 point 8 PzP.

The Ordering Party will examine whether the Contractor whose tender has been rated as the most advantageous, is not subject to exclusion, based on the required dockestablishments and statements and information contained therein

5.1.2. Based on Article. 22 ust. 1b Pzp. The Ordering Party specifies the following conditions for participation in the proceedings:

2) condition of economic or financial situation, i.e.: a) Ordering does not specify the condition of participation in proceedings in this respect. Contractors jointly applying for granting orders referred to in art. . 23 Pzp, they must jointly meetthe condition mentioned in art. 22 ust. 1b point 2 of the PPL - 6.2. According to art. 24aa paragraph 1 Pzp. The Awarding Entity will first evaluate the offers and then examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.

6.3. The ordering party, prior to the order being awarded, will call the contractor whose offer has been rated the most to the evilwithin a specified time, not shorter than 10 days, valid as of the date of submitting the following statements or documents:

List of statements or documents confirming no grounds for exclusion of the Contractor from participation in the proceedings

1 Current extract from the relevant register or from the Central Register and Information on Activities Economic, if separate regulations require an entry in the register orin order to demonstrate the absence of grounds for exclusion based on Art. 24 sec. 5 point 1 of the Act,

2 Current information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting offers,

3 Current certificate of the competent head of the tax office confirming that the contractor is not in arrearspaying tax, or a certificate that he obtained the lawful exemption, postponement or payment of overdue installments or suspension in full of the decision of the competent authority - issued not earlier than 3 months before the deadline for submitting bids;

4 Current certificate of the relevant branch of the Social Insurance Institution or Kasa Rolniczego Ubezpieczenia Społecznego confirming that the contractor is not in arrears with payment of social and health insurance premiums, or confirmation that he obtained the lawful exemption, deferral or installment payment of overdue payments or suspension in full of the implementation of the decision of the competent authority - issued no earlier than 3 months before the deadline submitting offers;

The above-mentioned documentsawca shall submit in the form of the original or a copy certified as a true copy by the Contractor; - In the case of Contractors jointly applying for the order, these documents shall be submitted by each of those Contractors, in the form of the original or a certified copy of the original by the Contractor concerned; Contractor who refers to the resources of other entities in order to demonstrate fulfillmentand in the scope in which it relies on their resources, the conditions for participation in the proceedings are also submitted by the document referred to in this point of the specification concerning those entities.

10 Statement on the offered medical devices prepared according to the template constituting the AnnexNo. 3 to SIWZ

- in the form of the original or a copy certified for compliance with the original by the Contractor.

In the case of Contractors jointly applying for the award of the contract, referred to in Article. 23 of the PPL, these documents are submitted by the plenipotentiary of these Contractors; - the Employer does not plan to provide similar contracts referred to in art. 67 sec. 1 point 6 Pzp.

The ordering party does not provide for the award of contracts-additional for supplies referred to in art. 67 sec. 1 point 7 PzP.
