The subject of the order is the purchase and delivery of products necessary to prepare meals for patients of the Day Care House located at ul. Mehoffera 72/74, 03-131 Warsaw. A detailed description of the subject of the order is included in Annex No. 2.1-2.9 to the ToR.

The subject of the order is the purchase and delivery of products necessary for the adventurecatering for patients of the Day Care Home located at ul. Mehoffera 72/74, 03-131 Warsaw. A detailed description of the subject of the order is included in Annex No. 2.1-2.9 to the ToR
Due to the limited number of characters in individual fields in the form, information about the offer and the list of declarations and documents confirming the absence of grounds are excluded herea, the conditions for participating in the proceedings. The numbering is in accordance with the order documents (SIWZ), where all details regarding the procedure are placed.
1. Contractors who can apply for the contract:
1.1 are not subject to exclusion based on the provisions of art. 24 paragraph 1 points 12-23 and additionally pursuant to art. 24 paragraph 5 item 1 of the PPL.
A) Contractor who is subject to exclusion on the basis ofe art. 24 paragraph 1 points 13 and 14 and 16-20 or par. 5 Public Procurement Law, may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove the repair of damage caused by a crime or tax offense, monetary compensation for harm suffered or compensation, comprehensive explanation of the facts and cooperation with the organus to prosecute and take specific technical, organizational and personnel measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the Contractor. The first sentence shall not apply if the Contractor, being a collective entity, has been ordered by a final and binding court ruling to not apply for the contractand the period of validity of the prohibition specified in this judgment has not expired.
b) The Contractor shall not be excluded if the Employer, taking into account the weight and special circumstances of the Contractor`s act, deems sufficient evidence provided pursuant to Art. 24 paragraph 8 Public Procurement Law
c) In the cases referred to in art. 24 paragraph 1 point 19 of the Public Procurement Law, before excluding the Contractor, the Employer provides this Contractor withthe desire to prove that his participation in the preparation of the procurement procedure will not distort competition. The contracting authority indicates in the protocol how to ensure competition.
D) The contracting authority may exclude the Contractor at any stage of the contract award procedure.

2 In the case of Contractors jointly applying for the award of the contract, the conditions set out in point 1.2, provided thatthey were specified by the Employer, they can meet together, while demonstrating the absence of grounds for exclusion referred to in point 1.1. must be demonstrated by each of the Contractors.
3 The Contractor who does not demonstrate compliance with the conditions for participation in the procedure indicated by the Employer above and does not show no grounds for exclusion, will be excluded from the procedure.
4 The Contractor may confirmand to meet the conditions for participation in the procedure,
Where appropriate, and in relation to a specific contract, or part thereof, rely on the technical or professional capacity of other entities, regardless of the legal nature of the legal relations between them.
4.2 The contractor who relies on the capacity or the situation of other entities must prove to the Employer that by implementing the orderhe will have the necessary resources of these entities, in particular, presenting the undertaking of these entities to make available to him the necessary resources for the needs of the contract.

4.4 The Employer will assess whether available to the Contractortechnical or professional abilities by other entities, allow the Contractor to demonstrate compliance with the conditions for participation in the proceedings and will examine whether there are grounds for exclusion for this entity, as referred to in art. 24 paragraph 1 point 13 22 and par. 5 point 1 of the Public Procurement Law Act in the scope indicated

5 Pursuant to art. 36b paragraph 1 of the PZP Act, the Employer requests the Contractor to indicate in the FormOffers of the part of the contract which the Contractor intends to entrust to subcontractors and the submission by the Contractor of the companies (names) of subcontractors
6 The contracting authority assesses whether the technical capacity available to the Contractor by other entities

4) Your personal data will be stored in accordance with art. 97 paragraph 1 of the Public Procurement Law, for a period of 4 years from the date of termination of the contract award procedure, and if the duration of the contract exceeds 4 years, the storage period covers the entire durationof the contract;
5) your obligation to provide personal data directly related to you is a statutory requirement specified in the provisions of the Public Procurement Law, related to participation in a public procurement procedure; the consequences of not providing specific data result from the Public Procurement Law;
