Purchase of MZKS mobile crushing and sorting set for PGE GiEK Branch Coal Mine Bełchatow

The subject of the Order is delivery of one crushing and sorting set consisting of from:

One seta crushing - sorting consisting of:

1. one mobile jaw crusher on a tracked chassis;

2. one mobile second degree cone crusher with material spreading on a tracked chassis.

A detailed description of the subject of the Order is included in Attachment No. 1 to the ToR.

1. Contractors may participate in the Proceedings for which there are no grounds for exclusion from the Proceedings nand based on art. 24 sec. 1 point 12 -23 of the PPL Act, subject to art. 133 ust. 4 of the PZP Act and are not subject to exclusion pursuant to art. 24 sec. 5 point 1 of the PPL Act. The exclusion takes place in the cases specified in art. 24 sec. 7 Public Procurement Law

2. The Contractor for the initial confirmation of compliance with the conditions of participation in the proceedings and demonstrating the absence of grounds for exclusion, is obliged to submitalong with the offer of a completed Uniform European Order Document form hereinafter referred to as "EAT" in electronic form, and the file must be marked with an Electronic Signature, in accordance with the provisions described in clause 16 of the ToR.

2.1. The Contractor who refers to the resources of other entities in order to demonstrating the absence of grounds for exclusion and compliance with them, in so far as they relateon their resources, the conditions of participation in the Procedure, also submit the EMS regarding these entities in electronic form in accordance with the provisions described in point 16 of the SIWZ.

2.2. In the event of a joint application by the Contractors, a document should be attached to the EAT of each of the Contractors jointly applying for the Order. These documents confirm compliance with the conditions for participation in the proceedings andno grounds for exclusion to the extent that each of the Contractors demonstrates fulfillment of the conditions for participation in the Procedure and no grounds for exclusion.

3. In order to confirm compliance with the conditions for participation in the proceedings and the lack of grounds for exclusion from the proceedings, the Contracting Authority shall call the Contractor before sending the invitation to participate in the electronic auction (pursuant to Article 26 paragraph 2f of the Public Procurement Law)ow, and in the absence of grounds for conducting electronic auction, prior to granting the order (pursuant to Article 26 paragraph 1 of the Public Procurement Law), it will call the Contractor whose tender was the highest rated, to submit the following statements and documents:

3.1. information from the National Criminal Register in the scope specified in art. 24 sec. 1 item 13-14 of the PZP Act, subject to art. 133 ust. 4 UPzp (applies to: natural persons, members of the management board, members of supervisory boards, proxies, partners of public and partnership companies, general partners in the limited partnership or limited joint-stock partnership) valid as at the deposit date (issued not earlier than 6 months before the deadline for submission of Offers);

3.2. information from the National Criminal Register in the scope specified in art. 24 sec. 1 pkt 21 Public Procurement Law (information should refer to collective entities) issued not earlier than 6 months before the deadline for submission of Offers;

3.3. excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to demonstrate the absence of grounds for exclusion based on art. 24 sec. 5 point 1 Sety Pg.

In the case of a joint application for awarding the Order by two or more Contractors, the said documents listed in point. 3.1 - 3.3 is filed separately by each Contractor. • In case the Contractor uses the resources of another entity under the conditions specified in art. 22a of the PZP Act, the said documents listed in point 3.1 - 3.3 is submitted by each of these entities

4. Detailed informationinformation on the statements or documents confirming the fulfillment of the conditions for participation in the proceedings and no grounds for exclusion can be found in point 12 of the SIWZ.

This procurement procedure is carried out in accordance with the principles set out in this document, and, to the extent not covered by it, the provisions included in the Procurement Procedure of PGE GiEK S.A., andGood Purchasing Practices, including the Code of Conduct for Business Partners of GKPGE Companies, available at https://pgegiek.pl/Przetargi/Przetargi-zupupowe, as well as the provisions of the Civil Code.

Contractor joining the Procurement Proceedings declares that he has read with the principles set out in the abovementioned documents. The Contractor assures that in his activity he will beday, obey all applicable laws and the provisions of the abovementioned documents, in addition he will exercise due diligence so that his employees, associates, subcontractors or persons with whom he will provide services comply with the provisions of the above documents.

2. Contractors are required to familiarize themselves withwith the content of this message.

3. The Contracting Authority informs that MPP (the Split Billing Mechanism) introduced by the amendment to the Act on tax on goods and services (VAT) of 15/12/2017

4 applies for payment for liabilities. Contractor, within 3 days from posting on the website information from the opening of Offers, referred to in art. 86 par. 5 of the Pzp Act, it provides the Ordering Party with a Statement aboutaffiliation or lack of belonging to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law.

With the submission of the Statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. The pattern of the Statement is Annex 5 to the ToR.
