The subject of the contract is the service of reading measuring systems in the area of activity of Polska Społki Gazownictwa Sp. z o.o. Branch of the Gas Plant in Olsztyn. A detailed description of the subject of the contract is included in Annex 3 to the ToR, the specimen contract with attachments. The contractor applying for the contract, both at the stage of the procedure as wellduring the implementation of the object of the contract, he may not be the Principal of the distribution service (ZUD) within the meaning of the applicable Instruction of the operation and distribution network (IRiESD) available on the Employer`s website at www.psgaz.pl, in the tab: For Client / IRiESD / Files to download. The Employer requires employment on the basis of an employment contract by the Contractor or Subcontractoran adviser of persons performing activities during the implementation of the contract, consisting of performing administrative and office work, including progress reporting.

In the event of a justified need of the Employer, may, with the prior consent of the Contractor, under the option law enabling the commission of more readings, entrust performance additional readings at another Departmentin Gas, in Gdańsk, in Bydgoszcz, in Białystok, in Warsaw covering the area indicated with the proviso that the unit price of the reading will not change, and unless the same Technical Instructions apply in those departments.

The Purchaser does not describe how to assess compliance with this condition .

The contractor will meet the condition if he shows that he is insured against the answercivil liability in respect of the operations related to the subject of the contract for a guarantee sum of at least PLN 1, 000, 000 (in words: one million zlotys).

1. The Contractor is excluded from the public procurement procedure in relation to which any of the circumstances referred to in art. 24 paragraph 1 point 12 23 (with the exception of Article 24 paragraph 1 point 13 letter dArt. 133 section 4 of the PPL Act) and para. 5 point 1 8 of the PPL Act

2. Point 8 of the ToR contains statements and documents which the Contractors are obliged to provide to confirm compliance with the conditions for participation in the procedure and to demonstrate the absence of grounds for exclusion.

3. The contracting authority informs that it will carry out the proceedings in accordance with art. 24aa of the Act, which means that the Purchaser will first evaluate the offers, andthen it will examine whether the Contractor whose tender has been assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings.

4. If the Contractor avoids the conclusion of the contract or fails to provide the required security on due performance of the contract, the Employer will examine whether it is not subject to exclusion and whether it meets the conditions for participation in the proceedings. The Contractor who submitsł the highest rated offer among other offers.

5. The Contractor shall attach to the offer the documents and statements indicated in point 12.4 of the ToR. The remaining documents shall be submitted by the Contractor at the request of the Employer.

6. Documents and statements referred to in item 12.4. and in point 10.4. The ToR should be submitted via the PSG purchasing platform in the form of an electronic document affixed by their issuer, sqan altered electronic signature. Documents and statements mentioned in point 12.4.2 12.4.4 and in point 10.4. should be submitted in original, i.e. it is not allowed to submit copies of these documents and statements.

7. The Contractor, within 3 days of posting on the website information from the opening of tenders, referred to in art. 86 section 5, provides the Awarding Entity with a declaration on the grantaffiliation or non-belonging to the same capital group as referred to in item 7.1.12. Terms of Reference. Along with submitting the declaration, the Contractor may provide evidence that links with another Contractor do not lead to a distortion of competition in the procurement procedure.

8. Communication and exchange of information between the Employer and Contractors takes place in Polish while maintaining the form of electronic via the PSG purchasing platform.
