- Requirement no. 4 - Compliance with the obligations to pay to the consolidated state budget. The economic operator (leader, associate, third party) will fill in the appropriate requirement in the DUAE form in the award documentation.(including by the affiliate bidder of the auction winner or the supporting third party, as the case may be) will be required to submit the following documents, by the date of conclusion of the award procedure report, to the tenderers placed on the 1st, 2nd and 3rd place after applying the award criterion :

- Certificate of fiscal attestation for legal entities regarding the payment obligations-to the consolidated state budget, original or certified true copy of the original, document showing that the tenderer has no overdue debts at the time of submitting this certificate. In this case, the provisions of art. 166 par. (2) of the Law no. 98/2016 regarding public acquisitions,

- Certificate of fiscal attestation forlegal persons regarding the obligations to pay to the local budget, in the original or a copy certified on their own responsibility for compliance with the original, a document showing that the tenderer has no outstanding debts at the moment when he has to present this certificate.

In this case, the provisions of art. 166 par. (2) of the Law no. 98/2016 on Public Procurement,

The economic and financial situation of the economic operator participating in the award procedure of the acquisition contract publish, respectively global turnover over the last three years. The bidders will prove-that in the last 3 years (2015, 2016, 2017) they have achieved a global average turnover of at least RON 274, 000.00 excluding VAT, or at least equal to or higher than the estimated value of the largest contract subsequently. The turnover value in euro will be determined on the basis of the average RON / EUR exchange rate communicated by the National Bank of Romania for the respective year, as follows:

- the average R rateON / euro 2015 = 4.4450 RON,

- average rate RON / euro 2016 = RON 4.4907, - average RON / EUR 2017 = RON 4, 5229.

The leader of the association, alone or together with associations and third party supporters (as the case may be) must ensure this average of the overall turnover. For the equivalent of a declared turnover in a currency other than RON and Euro, the annual average RON / currency exchange rate, -by the NBR. The average level of turnover was established according to the estimated value of the largest subsequent contract and taking into account the provisions of art. 175 par. (2) lit. a) and art. 180 par. (1) of the Law no. 98 / 2016.

Considering that the contracting authority will sign the framework agreement with the ecomomic operators on the 1 st, 2 nd and 3, as the case may be, the way of ranking the bids with equal scores will be as follows:

1) If the commission finds that they have been deposited / entered in SICAP more than two admissible tenders with equal scores to 1, 2 and 3 bidders, the contracting authority will send through SICAP a request for clarification (for) about the submission of new improved financial proposals (with 2 decimal places), and economic operators will forward their response using the facilities offered by SICAP, in which case they will contractit will be attributed to the bidder with the highest score obtained by the calculation algorithm, taking into account the award criterion "Best Value-Price Ratio." In the case of equality, and after the first request for clarification regarding the submission of new Improved financial proposals in SICAP, the contracting authority will again send via SICAP athe new request for clarification on the submission of new improved financial proposals (2 decimal places). In the case of maintaining equality and after the second request for clarification regarding the submission of new financial proposals improved in SICAP, the award procedure is canceled. Deadlines / dates for submission of new financial proposals will be communicated in the Transmit requestby the contracting authority. Without prejudice to the provisions of Law no. 182/2002 regarding the protection of classified information, with subsequent modifications and completions, the economic operator shall specify in the submitted offer the information contained in the technical proposal and in the financial proposal considered to be confidential, classified, protected by an intellectual property right, -in so far as objectively disclosing such information would prejudice the legitimate interests of the economic operator, in particular as regards commercial secrecy and intellectual property.
