Requirement: economic operators (leader, associate, subcontractor, third party supporter) who submit an offer, must prove that they are not in any of the exclusion situations mentioned in art. 59-60, 164, 165 and 167 of Law no. 98/2016 regarding public procurement.

Fulfillment mode: completing the DUAE from the award documentation by the economic operator (leader, associate, subcontractor, third party supporter) who confirms that he is not in any of the exclusion situations mentioned in art. 59-60, 164, 165 and 167 of Law no. 98/2016 regarding public procurement.

Fitting in one din the situations provided in art. 59-60, 164, 165 and 167 of Law no. 98/2016 regarding public procurement attracts the exclusion of the tenderer from the procedure applied for awarding the public procurement contract. 59-60 of Law no. 98/2016 regarding public procurement, will be presented in SEAP, in the section "Documents ofqualification ", by all participants (leader, associate, subcontractor, third party supporter), until the deadline for submission of the offer.

According to article 196 paragraph (2) of Law no. 98/2016, the bidder (leader, associate, subcontractor, third-party supporter, as the case may be) ranked first after applying the award criterion, until the date of the conclusion of the award procedure report, will present, at solicithe authority of the contracting authority, the supporting documents, which demonstrate the fulfillment of the qualification and selection criteria, according to the information contained in the DUAE, respectively:

1) certificates confirming the lack of debts to the local and state budget, regarding the payment of taxes and taxes (for the head office and the work points for which it existspayment obligations) and contributions to the general consolidated budget. Certificates will attest to the "lack of outstanding debts at the time of filing".

Forms will be submitted, issued by the competent authorities of the country where the bidder is resident, children and as appropriate, accompanied by their authorized translation. documents proving that operatothe economic role may benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2) and art. 171 of Law no. 98/2016;

2) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from certificationthe confirmatory liver issued by the ONRC / the constitutive act

The foreign bidders will present any edifying documents, issued by the competent authorities of the country in which they are resident, proving the fulfillment of the outstanding obligations to pay the taxes to the state budget and the local budget, in in accordance with the legislation of the country of residence.

The documents will be submitted in the new SEAP / SICAP with extended electronic signature, copy in accordance with the original and will be accompanied by the authorized translation.

Note: the qualification documents presented for the fulfillment of the requirements must be valid at the date of their submission.

1) In the situation in which there are two or more offers ranked on the first place, with equal scores, a new, improved price offer will be requested, which will be submitted electronically through SEAP, in which casee the award will be made to the tenderer who has the highest score;

2) No alternative offers will be accepted;

3) The bidders will specify in the technical proposal the information they consider confidential and which cannot be disclosed to third parties, mentioning the reasons for which this information must remain confidential;

4) DUAE can be accessed, in order to be completed by ainterested economic operators, through SEAP. The economic operators have the obligation to complete the DUAE with the offer, otherwise the offer will be declared unacceptable;

5) In case the public procurement procedure will be completed in 2020, the contract will be concluded within a maximum of 5 days from the date of approval of the own budget of Gorj County, for the year 2020. In the case in care, until 30.4.2020, the condition of the allocation of funds in the budget that will be approved for 2020 will not be fulfilled, the award procedure will be canceled.
