The economic operators who will submit the tender will be obliged to submit the tender for the whole lot, they will not be accepted offers submitted on the fractions of the lot respectively. Tenders submitted on the fractions of the respective lot will be declared non-compliant.

The economic operators of the tenderers / associations / third partiesthe proposed supporters / subcontractors should not find themselves in the situations referred to in art. 164, 165, 167 of Law 98/2016. The way by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with information related to their situation. Presentation of the criminal record of the economic operator and members of orgthe year of administration, management or supervision of that economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act. The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE are to be submitted at the request of the co-attracted only by the first-ranked bidder in the interim ranking made after applying the online award criterion. These documents may be: tax attestation certificates, certificates of absence of debts related to the payment of taxes, duties or contributions to the consolidated budget (local budget, state budget, etc.) at the moment of presenting thisor any document considered as edifying in this respect in the country of origin or in the country where the tenderer is established, such as certificates, criminal records or other equivalent documents issued by the competent authorities of that country. Tax certificates must attest to the absence of overdue debts at the time of their submission / submission. Requirement 1. Romanian legal / natural persons. Statement certificate issued by the national trade registry office indicating the object of activity of the respective economic operator. The information contained in this document will be actual / current at the time of submission. The way by which the fulfillment of the requirement can be demonstrated: the DUAE will be filled by the economic operators participating in the award procedure with the information related to their situation.to prove the fulfillment of the assumed by completing the DUAE shall be submitted at the request of the contracting authority only by the tenderer placed on the first place in the ranking in the intermediate rankings drawn up after application of the award criterion .. Requirement 2. Editorial documents proving that the activities of marketing, and provision of services in the fieldmedical care shall be carried out in compliance with the provisions of WHO no. 309/2015 (for the approval of the Methodological Norms for the application of Title XIX of the Law No. 95/2006 on the Health Reform, regarding the approval of the medical device activities), referring to the approval of the activities in the field of medical devices for marketing installation / in funification and service, activities to be covered by this acquisition. To fulfill requirement 2 and in accordance with art. 926 of Law 95/2006 shall be presented the Operating Notice for activities of marketing, distribution and provision of medical devices services issued by the Ministry of Health (through its NAMMD structure) according to the provisions of art. 3 of O M.S. no. 309/2015, including the annexes thereto, in force at the time of its submission.
