1) Requirement: the bidders in the procedure will declare that they do not fall within the situations stipulated in art. 59, art. 164, 165 and 167 of Law no. 98/2016 on public procurement.

1) Mode of accomplishment: At the time of submitting the offer, the participating economic operators will have to declare / confirm by DUAE their non-compliance with the grounds for exclusionthe procedure being followed in relation to the provisions of art. 196 of Law no. 98/2016 the contracting authority shall require the tenderer ranked first in the intermediate hierarchy following the completion of the evaluation of the tenders to submit: - the criminal record certificate of the economic operator and of the members of the management, management or supervisory body of the economic operator have a computerit is represented, decision-making or control within it as it results from the certifying certificate issued by ORC / constitutive document or, as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. For viewing the awarding documentation uploaded in SEAP, the economic operators must have a necessary program to view the electronically signed files (the websites of the electronic signature providers) according to art. . 60 par. (4) of GD 395 / 2016.

Rules for communication and data transmission:

- requests for clarifications related to pthe awarding documentation will be exclusively addressed to the SEAP at the Section of Questions in the award procedure conducted by electronic means, and the responses to them will be published in SEAP both in the Questions section and in the Documentation Section, clarifications and decisions within of the contract notice, the contracting authority not to submit the applicationaddressed by means of communication other than that established in accordance with the provisions of Art. 64 par. (1) of the Law no. 98/2016 on public procurement, - for submitting requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP (www.elicitatie.ro) as an economic operator and as a participant in the awarding procedure, - for commonSubsequent Submissions: The Evaluation Committee will forward requests for clarification of the tender by using the technical facilities available in the SEAP (Section "Questions").

Economic operators will forward the answers to the clarifications and any requested documents during the evaluation of the tenders through SEAP .

The contracting authority reserves his /the ect that if for certain lots it does not materialize the source of financing to order the cancellation of the award procedure (for the lots in question), the decision to be adopted at the latest at the date of drawing up the award report.
