The quantities are specified in the tender specifications.

The bidders, the supporting third parties and the subcontractors must not find themselves in the situations provided by art.164, 165, 167 of the Law no.98 / 2016. which can be demonstrated to meet the requirement: it will be completed by the economic operators participating in the award procedure with the informationto their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidders placed on the first three places in the interim ranking made at the completion of the evaluation of the tenders. These documents can be:

1. • certificates of absence of DEBTOR DUTIES regarding-to pay taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation; 2. • the criminal record of the economic operator and the members of the management, management or supervisory body of the respective operator economic, or those who have power of representation, decision-making or control within it, as it turns out• 3. • as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016; • 4 • other editorial documents, as the case may be; • the decision-making bodies of the contracting authority, in-regarding the organization, running and finalization of the award procedure, are:

The tenderer, the third party and the subcontractor (as the case may be) must not be subject to Art. 60 of Law no. 98 / 2016. Modality by which the fulfillment of the requirement can be demonstrated: a statement to this effect, together with the submission of tenders.

The economic operators submitting the tender must prove a form of registration under the law of the resident countryto prove that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment and that he has the professional capacity to perform the activities that are the subject of the contract.

How to prove the fulfillment of the requirement: The DUAE will be filled in by the economic operators participating in the award procedure with the informed personrelated to their situation. The supporting documents proving the fulfillment of the ones assumed by the completion of the DUAE, respectively the certifying certificate issued by the ONRC, or in the case of the foreign tenderers, equivalent documents issued in the country of residence, shall be presented at the request of the contracting authority only by the tenderers placed on the first three places in intermediate rank iDrafted to complete the evaluation of tenders.

Where two or more offers are located in the same place, the contracting authority shall ask the tenderers for a new financial proposal, without this affecting the top positions in the ranking, and the contract will be awarded to the bidder whose new financial proposal has the lowest price, according to art. 138 par. (2) and (3) of H.G. 395/2016, amended and completed.
