1) Bidders, third parties and subcontractors must not find themselves in the situations provided for in art. 164, 165, 167 of Law no. 98/2016. The way by which-the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by the completion of the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer ranked first in the interim classificationwould draw up the evaluation of the tenders;

2) The declaration regarding the non-compliance with the situations stipulated in art. 58 63 of the Law no. 98/2016. The decision-makers of the contracting authority, regarding the organization, carrying out and finalization of the procurement procedure are:

3) Fiscal attestation regarding the payment of the exigible obligations to the state budget and to the state social insurance budgets (health, pensions, unemployment), showing the lack of overdue debts at the moment of their deposit; taxes and local taxes - Issued-by the local town hall, which shows the lack of overdue debts at the time of their deposit. According to the provisions of art. 193 of Law 98/2016, the contracting authority will accept the preliminary proof in the tender documents of the DUAE (Single European Procurement Document), instead of the documents required for the demonstration of the qualification requirements, including the exercise capacity, as a preliminary proof;the judicial authority of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of those who have the power of representation, decision or control within the economic operator as it results from the certifying certificate issued by the ONRC / act The DUAE may be downloaded for completion and submission at: https: // ec.europa.eu/growth/toolsdatabases/espd/filter (instructions for completing DUAE are available at www.e-licitatie.ro)

Prior to the award of the framework agreement, the contracting authority will ask the tenderer ranked first after the application award criterion to present up-to-date supporting documents demonstrating the fulfillment of all caliber criteriawhich, according to the information contained in the DUAE. The DUAE will also be submitted, if necessary, by the supporting party. In the case of foreign economic operators, equivalent documents issued in accordance with the law applicable in the country of residence will be presented.

Economic operators submitting a tender must prove a form of registration under the law of the country of residence, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment, and that he has the professional capacity to carry out the activities covered by the contract. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, to their situation. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively the certifying certificate issued by the ONRC to present real / actual information at the date of their presentation or, in the case of foreign tenderers, equivalent documents issued in the country of residence, are to be submitted at the request contracting authority, only by the tenderranked first in the mid - term ranking of the bid evaluation
