CPV Description: Providing a NAS-like storage system, including the provision of related services described in the Task Sheet
Media Storage and Reader Devices.
Providing "NAS Storage System" equipment, providing services such as: delivery, installation, connection to the grid, configuration, testing, commissioning-as well as the training of AADR's specialized personnel, in order to operate in good condition the equipment provided and installed.
Also, all materials and services necessary for transport, handling of the equipment and its connection to the AADR electrical network will be provided by the supplier, without additional costs from the AADR.
Number of days untilmay request clarification prior to the deadline for submission of tenders / applications: 15.
The contracting authority will respond clearly and completely to all requests for clarification or additional information on the 10th day before the deadline for submitting tenders. the participation guarantee is 1% of the estimated value of the acquisition, respectively 15 000.00 RON according to art.-35 of H.G. no. 395/2016 corroborated with the provisions of art. II. par. 2 of H.G. No 866/2016 for modification and completion of H.G. no. 395/2016. The period of validity of the participation guarantee is equal to the period of validity of the offer, ie 120 calendar days from the deadline for the submission of tenders. The guarantee of participation can be constituted, according to art. 36 par.(1) of H.G. no. 395/2016 by bank transfer in favor of AADR or by a guarantee instrument issued in accordance with the law in favor of AADR, by a banking corporation or by an insurance company which is not in special situations regarding authorization or supervision, according to the law. The participation guarantee will be charged in SEAP using the extended electronic signaturelater than the date and time limit for the submission of tenders provided in the tender documentation and must be submitted in accordance with form no. 1 in the "Forms" section.
It is advisable to issue the guarantee of participation by a bank having a correspondent in Romania. In the case of submitting joint offers, the guarantee instrument must explicitly stipulate thatthe guarantee is constituted in the name of the association and mention that it collectively covers all members of the group of economic operators
Equivalence for the participation guarantee deposited in another currency will be made at the NBR exchange rate from the date of publication of the participation notice. issued in a language other than the Romanian language, will be accompanied by an authorized translation in Romanian.Contracting Authority: RO32TREZ7025005X016245, opened at Treasury Sector 2, fiscal code RO32722680. The performance guarantee of the contract, set up by the contractor, will be 10% of the value of the contract in RON, without VAT. The guarantee of good execution is constituted, according to art. 39 par. (3) of the HG no. 395/2016, within 5 days of signing the contract, for the entire period of validityof the contract and must be submitted in accordance with Form no. 10 of the section: "Forms." The guarantee of good execution is constituted in accordance with Article 40 paragraph (1) of GD No. 395/2016 by bank transfer in favor of AADR or by a guarantee instrument issued under the law in favor of AADR, a banking corporation or an insurance company that is not located(s) of the Contracting Authority: RO32TREZ7025005X016245, opened at the Treasury Sector 2 Fiscal Code RO32722680.

Requirement No. 1.
The tenderers, the third parties, the subcontractors must not be found in the situations provided for in art. 164, 165, 167 of Law no. 98/2016
Dothe supporting evidence that proves this requirement may be:
1) The judicial record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision or control, as evidenced by the on-going certificate issued by the ONRC; 2) Finding certificatesthe lack of overdue debts on the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation. From these tax certification certificates there must be a lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget etc.), valid at the time of the presentation; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on Public Procurement
Modality of completion:
The DUAE (Single European Procurement Document) will be completed by the participating economic operators (tenderer, -associate, third party, subcontractor) to the award procedure with information related to their situation. DUAE can be downloaded for submission and submission at https://ec.europa.eu/growth/tools-databases/espd/filter. Instructions on how to fill in the DUAE are available at www.e-licitatie.ro.
Up-to-date supporting documents demonstrating the fulfillment of the asumaby completing the DUAE, will be submitted at the request of the contracting authority, only by the tenderer ranked first in the interim ranking, drawn up at the completion of the evaluation of the tenders and before the award of the contract. These must be valid at the presentation date.

Special warnings:
In the case of submitting an offer in association, each member of the association has the obligation to prove the fulfillment of the requirement by presenting the supporting documents at the request of the contracting authority, respectively the economic operator ranked 1st in the interim ranking the evaluation of the offers;

The validity of the information will be reported at the date of submission of the documents .

This will be presented with DUAE by all economic operators (bidder, Social subcontractor third supporter).
For foreign legal persons the provisions of Article 168 of Law no. 98/2016 on public procurement.
Documents will be filed with extended electronic signature based on a qualified certificate issued by an accredited certification service provider under the law.

Economic operators must prove their registration as a Romanian legal person /foreigner, by submitting a certificate issued by the Trade Registry Office / other documents proving that the economic operator is legally constituted, that he is not in any of the situations of cancellation or, in the case of the offer of stains, equivalent documents issued in the country of residence, accompanied by their authorized translation or by their attendanceaccording to the law of the country of residence of the economic operator.
The subject of the contract must have a correspondent in the CAEN code that is authorized in the certifying certificate.
Way of fulfillment: DUAE (Unique European Procurement Document) will be completed by the participating economic operators (tenderer, associate, third party, subcontractor) to the award procedure with the informed personrelated to their situation. DUAE can be downloaded for submission and submission at https://ec.europa.eu/growth/tools-databases/espd/filter. Instructions on the completion of the DUAE are available at www.e-licitatie.ro.
Up-to-date supporting documents demonstrating the fulfillment of those undertaken by completing the DUAE, respectively the certifying certificate issued by the ONRC or cthe equivalent of documents issued in the country of residence accompanied by their certified translation or their professional membership according to the law of the country of residence of the economic operator shall be submitted at the request of the contracting authority only by the first ranked tenderer in the interim ranking, drawn up at the bid evaluationr and before awarding the contract.
