Placing an EAT with an offer on a data carrier (eg CD, pendrive) is not allowed, no-it constitutes its submission using means of electronic communication within the meaning of the provisions of the Act of 18.7.2002 on the provision of electronic services.

The ordering party declares that the maximum size of attachments sent in one e-mail can not exceed 25MB.
The contractor fills up the EMS by creating an electronic document. It can use the ESPD tool or other available tools or software that enable you to fill the EAT and create an electronic document, in particular in onefrom above format.
After creating or generating by the contractor an electronic document EIN, the contractor signs the above the document is a qualified electronic signature, issued by a qualified trust service provider, being an entity providing certification services, electronic signature, meeting the security requirements set out in the Act of 5/09/2016 on trust services orz from electronic identification (OJ 2016.1579).
The signed electronic document of the EAT should be encrypted, i.e. with an access password. For this purpose, the contractor can use the tools offered by the software in which the document is prepared (eg Adobe Acrobat), or use the open-source tools available on the market (eg: AES Crypt, 7-Zip and Smart Sign). However, the ability to decipher the handed document by the Ordering Party may not cause the Purchaser to purchase additional software. It is possible to use for this purpose the file formats indicated in lit. a) above. - The Contractor places the password of access to the EED file in the content of his offer, submitted in writing. The content of the offer may include if-it is necessary, also other information for proper access to the document, in particular information about the encryption program used or decryption procedure of data contained in EAT.
The Contractor sends the Ordering Party encrypted and signed by a qualified electronic signature on the above e-mail address in such a way that the document he reached the ordering party-before the deadline for submission of offers. The content of the sent message should indicate the sign and the name of the proceedings, which EAT applies, and the name of the contractor or any designation allowing the contractor to be identified (eg EED for the offer backhoe loader 2018 name of the contractor).

Zamawiający proposes a similar way of acting on the part of the contractor, who providing an email address should configure his program to email with an automatic return confirmation of the fact of receiving information from the ordering party.
The date of the E-MAIL message will be a confirmation of delivery of a message containing EIN with-Mail server of the Ordering Party.
The obligation to submit an E-mail in an electronic form with a qualified electronic signature in the manner specified above also applies to the EJU submitted on a summons pursuant to Art. 26 par. 3 PPL Acts; in this case, the Employer does not require encryption of this document.
The offer is made in writing under pain of nullity.
In the event that EAT is agonizedera of information that constitutes a company secret in accordance with the content of art. 8 of the Act of 29.1.2004 Public Procurement Law (i.e., OJ 2017.1579) should be sent in a separate file described in a way indicating that it contains business secrets. The electronic signature should be applied accordingly.
1. Each contractor must attach to the offer valid as of todaythe submission of offers, a declaration in the form of a Single European Order Document (hereinafter referred to as "EAT") prepared in accordance with the standard form provided for in the European Commission Implementing Regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU (see Appendix No. 2 to the ToR). The information contained in the statement will provide preliminary confirmation that the contractor has not beenega exclusion and meets the conditions for participation in the proceedings.
a) In case of joint application by Contractors (eg a Consortium), the Single European Order Document shall be submitted by each of the contractors jointly applying for the order. These documents should confirm the lack of grounds for exclusion to the extent that each of the contractors shows no grounds for exclusion and meetsconditions for participation in the proceedings.
b) The Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and fulfillment to them, to the extent that they refer to their resources, the conditions for participation in the proceedings are also submitted by the Uniform European Order Documents for these entities.
2. In order to confirm the lack of grounds for exclusion, pleasey properly fill in:
a) Part III: The grounds for exclusion table A: Basis related to convictions for crime of the Single European Order Document attached to the ToR;
b) Part III: The grounds for exclusion Table B: Fundamentals related to payment of taxes or social security contributions of the Single European Order Document Annex No. 2 to the ToR;
C)-Part III: The grounds for exclusion Table C: Principles related to insolvency, conflict of interests or professional misconduct of the Single European Order Document attached to the SIWZ; (d) Part III: Grounds for exclusion Table D: Other grounds for exclusion that may be provided for in the national provisions of the Member State of the contracting authority or contracting entitygo of the Single European Order Document, attachment No. 2 to the ToR.
3. The contracting party, prior to the selection of the best offer, will call the contractor whose offer has been rated the most, to submit within the prescribed, not shorter than 10 days, valid day of submitting the following declarations or documents:
In order to confirm the absence of grounds for: a) write-off proper rejestru or Central Register of Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1 of the Public Procurement Law;
b) certificate of the competent head of the tax office confirming that the contractor is not in arrears with paying taxes, issued not earlier than 3 monthsed the expiry of the deadline for submission of bids, or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible exemption, postponement or spreading overdue installments or suspending in whole implementation of the decision of the competent authority;to connect the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids or requests for participation in the proceedings or otherdocument confirming that the contractor has concluded an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained legally required exemption, deferral or installment payment of overdue payments or suspension of the full implementation of the decision of the competent authority;
d) information from the National Criminal Record in the scope specified-in art 24 sec. 1 points 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submission of tenders;
e) the contractor's statement that the court has not been the subject of a final court decision or final administrative decision on default of taxes, fees or social security or health insurance premiums, or - in the event of such a decision or decision - todocuments confirming payment of these receivables together with any interest or fines or conclusion of a binding agreement regarding the repayment of such receivables - in accordance with Annex 3A to the ToR;
f) the contractor's statement about the lack of a ruling against him as a preventive measure for the prohibition of applying for public orders - in accordance with Annex 3A to the Terms of Reference;
g) declarethe contractor not to pay taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws 2016.716) in accordance with Annex 3A to the Terms of Reference;
In addition:
- According to art. 24 section 11 of the Public Procurement Law, the Contractor, within 3 days of posting information on the website referred to in art. 86 section 5 of the PPL, pit orders the Employer to make a statement (in accordance with Annex No. 3) on belonging to or not belonging to the same capital group, referred to in the Act on competition and consumer protection (i.e., OJ 2017.229). With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedureand; The Contractor may use Annex 3 to the ToR;
- Employer in accordance with art. 25 ust. 1 of the Public Procurement Law, to confirm the fulfillment of the lack of grounds for exclusion, will use the documents contained in generally available databases.
- The contracting authority foresees the exclusion of the contractor based on art. 24 section 5 items 1, 2, 4, 8 of the Public Procurement Law, ie: - the contractor in relation to which liquidation was openedę, in the court-approved system in the restructuring proceedings, it is foreseen that the creditors will be satisfied by the liquidation of their property or the court ordered the liquidation of its assets pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (ie, Journal of Laws 2017.1508) or whose bankruptcy was announced, with the exception of the contractor who, after the bankruptcy, concluded an approved agreementa valid court order, if the arrangement does not provide for the satisfaction of the creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of its assets in accordance with art. 366 section 1 of the Act of 28.2.2003 Bankruptcy law (ie, OJ 2017.2344);
- performers who in a way committed seriously violated professional duties, which undermines his integrity, especially when the contractor in thehe or she has not performed or improperly performed the order of intent or gross negligence, which the orderer is able to demonstrate by means of appropriate evidence;
- contractor who, for reasons attributable to him, did not execute or did not properly execute the prior public procurement agreement with the ordering party referred to in art. 3 par.1 pkt 1-4 which led to the termination of the contract or compensation for damages;
- contractor who has violated obligations regarding tax payments, fees or social security or health insurance premiums, which the contracting authority is able to demonstrate by means of appropriate evidence, except in the case referred to in paragraph 1 point 15 of the Public Procurement Law (i.e., OJ 2017.1579), unless-the contractor has made payment of taxes, fees or social or health insurance contributions, including interest or fines, or has entered into a binding agreement regarding the repayment of such claims. If the Contractor indicates availability of declarations or documents referred to in Chapter Ix.ust. 4 and par. 9, in electronic form under specified Internet addressesfrom available and free databases, the Ordering Party shall collect the statements or documents indicated by the Contractor individually from these databases.
6. In the case referred to in the preceding sentence, the Employer may request from the Contractor to provide a translation into Polish specified by the Contractor and documents collected by the Ordering Party.
7. If indicated by the Contractorstatements or documents referred to in Chapter Ix para. 4 and par. 9, which are at the disposal of the Employer, in particular declarations or documents held by the Employer pursuant to the provisions of art. 97 section 1 of the PPL Act, the Ordering Party in order to confirm the circumstances referred to in art. 25 paragraph 1 point 1 and 3 of the Act, use the statements or documents held, if any-they are current.
8. The Contractor is not obliged to submit declarations or documents confirming the circumstances referred to in art. 25 paragraph 1 point 1 and 3 of the Act, if the Orderer has statements or documents related to this Contractor or may obtain them through the use of public and free databases, in particular public registers within the meaning of the Act of 17.2.2005. on informatisation of the activities of entities implementing public tasks (i.e., OJ 2017.570).
9. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in Chapter Ix para. 4 point 2):
1) within the scope of the documents indicated in point (d) - submit information from the relevant register or, in the absence of such a register, another rthe most important document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence is the person concerned by information or a document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 of the PPL;
2) within the scope of the documents indicated in point a) - c) - submit a document or documents issued in the country in which he is sittingiba or place of residence, confirming that: a) its liquidation has not been opened or bankruptcy has been declared, b) is not in arrears with taxes, fees, social security and health insurance contributions or that it has entered into an agreement with the competent authority regarding the repayment of these receivables along with any interest or fines, in particular obtained the legally required exemption, rebatethe payment of overdue payments or suspension in installments of the decision of the competent authority,
3) Documents referred to in Chapter Ix para. 9 point 1) and 9 point 2) lit. a) should be issued no earlier than 6 months before the deadline for submission of tenders. Documents referred to in Chapter Ix para. 9 point 2) lit. b) should be issued not earlier than 3 months before-expiry of the deadline for submission of tenders.
10. If the country in which the Contractor has his registered office or place of residence has the person concerned, the documents referred to in paragraph 9 shall not be issued, shall be replaced by a document containing the statement of those persons submitted before the notary or before the competent due to the place of residence of these persons, a judicial body, admia professional or commercial self-governing body competent for the place of residence or place of residence of the contractor or place of residence of that person. The dates mentioned in chapter Ix para. 9 point 3 apply accordingly.
11. Certificates of compliance with the original are made by the Contractor or a third party or the Contractor jointly applying for the award of a public order fromaccordingly, in the scope of documents that concern each of them.
12. Confirmation of compliance with the original is in a written form signed with a handwritten signature.
13. In the event of a joint application by the Contractors, the Single European Order Document shall be submitted by each of the contractors jointly applying for the order. These documents should confirm fulfillconditions for participation in the procedure and there are no grounds for exclusion to the extent that each of the contractors shows compliance with the conditions for participation in the procedure and no grounds for exclusion.
14. Documents prepared in a foreign language are submitted together with a translation into Polish. No translation is required if the Purchaser has given his consent, referred to in Article 9 para. 3 Public Procurement Laws.
15. Common descriptionSatisfactory assessment of the fulfillment of the above conditions: • The Ordering Party will check the correctness of the submitted documents and compliance with the aforementioned ones as required to participate in the tender. The Employer will assess the fulfillment by Contractors of the condition of participation in the proceedings based on the attached documents and statements, according to the formula meets - does not meet. The Contractor meets on the day of submitting offers. If Contractors fail to demonstrate compliance with the conditions for participation in the proceedings, they will be excluded from the proceedings on the basis of the relevant provisions of the Act of 29.1.2004.Public spaces (ie, OJ 2017.1579).
16. The contractor whose offer will be evaluated as the most advantageous (ie before announcing the information about the selection of the most advantageous offer) will be called by the Ordering Party to submit in the designated, not shorter than 10 days, the current date at the submission of the letter statements or documents confirming that the Contractor is not subject to exclusion, meets wterms of participation in the proceedings and the services it offers meet the requirements specified by the Employer.
Employer, provides for the possibility that first evaluate the offers, and then examine whether the Contractor, whose offer was evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings.
