Tenderers, third-party suppliers and subcontractors do not have to-is found in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the undertaken by the completion of the DUAE are to be presented on the groundcontracting authority, only by the tenderers ranked on the first three places in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents may be: (a) certificates of absence of overdue debts in respect of the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation;the criminal record of the economic operator and of the members of the management, management or supervisory body of the economic operator or of those having the power of representation, decision or control within the economic operator as it results from the certifying certificate issued by the ONRC / act (c) as the case may be, documents demonstrating that the econo operatorsmall can benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, (d) other editorial documents, as the case may be.

A statement according to art. 60 of Law 98/2016, which will be submitted by all participants, together with the filing of the DUAE.

The economic operators submitting the tender must prove a form of registration under the law of the country of residence, from which it appears that the economic operator is legal established that he is not in any of the situations of cancellation of the constitles, as well as having the professional capacity to perform the activities that are the subject of the contract. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively the certifying certificate issued by O.NR.C. or, in the case of foreign tenderers, equivalent documents issued in the country of residence are to be submitted, at the request of the contracting authority, only by the bidders placed on the first three places in the intermediate rankings drawn up to complete the evaluation of the tenders. The information in the certificate must be true / valid atdate of its submission.

Food Safety Registration Document issued by the National Veterinary and Food Safety Authority (original / certified copy / legible copy with the reference in accordance with the original), according to H.G. 924/2005 art. 6 par. (3). The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be completed by the participating economic operatorsand to the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, only by the bidders placed on the first 3 places in the intermediate rankings drawn up at the completion of the evaluation of the offers.
