1. Failure to comply with the provisions of art. 164 of Law 98/2016 on public procurement. The economic operator (individual bidder, membru of an association, subcontractor, third-party supporter) will initially complete the corresponding requirement in the DUAE form from the award documentation, after which an edifying document will be presented in this sense, such as: - The criminal record of the economic operator and the members of the management body or management of the respective economic operator, or of those with the power ofrepresentation or decision, as it results from the certifying certificate issued by the ONRC / the constitutive document, valid at the time of their submission; - other documents edifying in this regard; The preceding statement will be understood as follows: the criminal record is presented for the persons who, according to the Certifying certificate issued by the National Trade Register Office, appear on the form levelof natural persons and / or legal persons UNDERTAKED, considering that this document reflects the information in the constitutive act of setting up the economic operator in question (see Case 370 of the Spete Library available at https://achizitiipublice.gov.ro/ QUESTIONS / view /). This document must be presented in original only by the tenderer ranked first after applyingthat the award criterion (including by the associate bidder or the supporting third party, as the case may be), until the date of the conclusion of the award procedure report, according to art. 196 paragraph (2) of Law 98/2016 on public procurement. Framing in the situation provided in art. 164 of Law 98/2016 on public procurement attracts the exclusion of the tenderer from the procedure applied for awarding the contractpublic procurement. 2. Failure to comply with the provisions of art. 165 of Law 98/2016: The economic operator (individual tenderer, member of an association, subcontractor, third-party supporter) will initially complete the corresponding requirement in the DUAE form from the award documentation, after which an edifying document for this purpose will be presented, such as : - demonstration of the non-classification in prev. art. 165 paragraph 1: fiscal record; - demonstration of the non-classification in prev. art. 165 paragraph 2: fiscal certificates / fiscal attestation / evidence regarding the lack of outstanding debts (taxes, taxes or contributions) to the local and state budget, at the time of their submission; - If applicable, documents provided in art. provided in art. 166 para. (2), of Law no. 98 of 19.05.2016 regarding Achillespublic meetings; - other documents edifying in this regard; These documents must be presented in original only by the bidder ranked first after applying the award criterion (including the associated bidder or the supporting third party, as the case may be), until the date of the conclusion of the award procedure report, according to art. 196 paragraph (2) of Law 98/2016 on public procuremente. 1. The method of dividing the offers with equal prices ranked in the first place: A new financial proposal will be requested, according tort. 138 paragraph (2) of H.G. 395/2016 and notification no. 262 09.11.2017 of ANAP, regarding the off-line transmission of new financial proposals of equal value. 2. For documents issued in a foreign language, translations made by an authorized translator will be presented. 3. The price that will be taken into account when establishing the winning bid will be the total price / batch of products resulting from the sum of the values obtained from multiplying the quantitiesmaximum (possible to purchase based on the framework agreement) of each product within the lot with its unit price. 9. In the event of any subcontracting, the provisions of art. 218 220 of Law no. 98/2016, situation in which the contractual clauses will be updated. 10. Based on art. 10 of H.G. 445/2003, until the signing of the framework agreement, the economic operators declared a profitactors must obtain the NATO code of economic agent (NCAGE code, granted by the National Coding Office or SCAGE code assigned by NAMSA Nato Maintenance and Supply Agency depending on the state in which the economic operator is registered). After signing the subsequent contracts, the contractor will pick up from the National Coding Office the form of the Idea Projecttification (form F11) to complete the coding data of the endowment article. Providing the coding data for the gift item is mandatory and free of charge.
