2. The contracting authority requires the award of the contracted product, at least a 2-year warranty period (the warranty period is one of the criteria for the evaluation of offers)
3. Ordering Party requirements for employment by the Contractor or a subcontractor person under a contract of employment, as defined by the Labor Code, in accordance with art. 29 para. 3a of Pzp.:
1) Ordering requires that the activities undertaken by the contractor or subcontractor related to the implementation of the order, ie: analysis of materials submitted for ordering by the Ordering Party, carrying out the determination of property boundaries, activities related to the exposition of the EGiB modernization project, data input made in ordering to the Ordering Party's database, youwere performed by an employee in an employee on the basis of an employment contract (Article 22 (1) of the Act of 26.6.1974 Labor Code).
2) The contracting authority is entitled, during the whole period of the contract, to verify the form employment of employees referred to in point 1 when executing it. The Contractor during the performance of the contract, at the request of the Ordering Party will present the evidence confirmsfulfilling the obligation referred to in point 1.
The Contracting Authority shall be entitled to request it in a period not shorter than 5 working days: a) statements by the contractor or subcontractor regarding employment of persons under a contract of employment. This statement should contain in particular: precise specification of the entity submitting the declaration, date of submission of the declarationincluding the number of those persons, the type of employment contract and full-time job, and the signature of the person authorized to make a statement on behalf of the contractor or subcontractor; The Contracting Authority provides for a sanction for non-compliance with the above requirement specified in the contract template attachment No. 4 to the ToR.
1. Oh, thank youContracts may be applied by Contractors who: are not subject to exclusion in the circumstances referred to in art. 24 sec. 1 and art. 24 sec. 5 point 1 of the Public Procurement Law, meet the conditions for participation in the proceedings.
2. In order to confirm the absence of grounds for exclusion from participation in the proceedings, the Contracting Party requests the following documents: information on the National Criminal Register in the scope specified in art.24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids or requests to participate in the proceedings;
b) excerpt from the relevant register or from central records and business information, if separate regulations require an entry in the register or records in order to confirm the absence of grounds for exclusion based onArt. 24 sec. 5 point 1 of the Public Procurement Law Act,
c) the contractor's statement that the court has not been the subject of a final court decision or final administrative decision on late payment of taxes, fees or social security or health insurance premiums or in the event of such a verdict or decision confirming the payment of these payments receivables with possible interest or lub) fines or conclusion of a binding agreement regarding repayments of such claims - d) declaration of the contractor about the lack of a ruling against him as a precautionary measure prohibiting applying for public orders. e) declaration of belonging or non-affiliation to the same capital group - (submitted in term .3 days from the posting of information on the subject of ktm in Article 86 paragraph 5 of the Public Procurement Law.)
3. If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in: - 1) section 2), point a). submit information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence or placeA person who is concerned with information or a document, in the scope specified in art. 24 sec. 1 item 13, 14 and 21.
2) section 2) letter b) submits a document or documents issued in the country in which he has his registered office or place of residence, confirming that his liquidation has not been opened or that bankruptcy has been declared. Documents referred to in paragraph 3 should be issued no earlier than 6 monthsbefore the deadline for submitting offers or applications for admission to participate in the procedure.
5. If in the country in which the contractor has a registered office or place of residence, the document referred to is not issued, the documents referred to in paragraph 3 are not replaced by a document containing the contractor's statement, indicating the person or persons entitledto its representation, or a statement of the person whose document was to be submitted, submitted to a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the seat or place of residence of the contractor or place of residence of that person. 6. Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document referred to in paragraph 2) lit. a), submits the document referred to in section 3 point 1) to the extent specified in art. 24 sec. 1, items 14 and 21. If the country in which the person to whom the document was to reside has their place of residence, no such documents are issued, it shall be replaced by aa statement of that person made before a notary or before a judicial, administrative or professional body competent for the place of residence of that person. The document should be issued not earlier than 6 m before the deadline for submission of offers. Important: continued conditions are included in section III.1.2)
1. The contracting authority may revoke the proceedingsNot to order, if the funds coming from the European Union budget and non-recoverable means of assistance granted by Member States of the European Free Trade Agreement (EFTA), which the contracting authority intended to allocate to finance all or part of the contract, were not awarded.
2. The bid bond must be submitted before the deadline for submitting offers, it may be-be brought in one or several of the following forms referred to in art. 45 par. 6 Pzp:

3. Under the offer binding period, two months should be understood as 60 days.
4. The offer in writing should be made in accordance with the model Offer form (Annex 2 to the Terms of Reference). 5. Declarations and documents must meet the requirements set out in the Public Procurement Law and in the provisions of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the procurement procedure (Journal of Laws of 2016, item .1126 and with reference to the Single Document, requirements specified in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 laying down a standard form for a single European order document (OJ L 3/16, 6.1. .2016) ..
6. There are no plans to: award contracts referred to in art. 67 sec. 1 point 6, 7 of the PPL Act, conclusion of a framework agreement, establishment of a dynamic systemhim for purchases, choosing an offer using an electronic auction.
7. Proceedings for granting a public order are carried out in the form of an unlimited tender, pursuant to the Act of 29.1.2004. Public Procurement Law (Journal of Laws of 2017, item 1579 as amended) and executive acts issued on its basis.
