Provision of technical support services for CommVault, Hitachi

The subject of the orders in accordance with Part II of the ToR is to provide technical support services for CommVault, Hitachi.

4. providing a guarantee for services rendered in accordance with the provisions contained in Part IV of the ToR with model contract and Part II of the Terms of Referenceand subject of the order.

5 According to art. 30 para. 4 of the Act, the Employer allows equivalent solutions described in the Terms of Reference by means of standards, European technical assessments, approvals, technical specifications and systems of technical references, referred to in art. 30 para. 1 point 2 and 3 of the Act, if they allow to obtain features or parameters not worse than recalled. A condition for using row solutionswritten approval by the Employer is valid. Differences between the referenced standards and their equivalents must be accurately described by the Contractor and submitted to the Employer for approval. The Contractor is obliged to provide electronically the current declaration as of the day of submitting the application, constituting preliminary confirmation that the Contractor is not subject to exclusion, meets the conditionsin the proceedings and selection criteria. The Contractor should submit the declaration on the form of the Single European Order Document (hereinafter the EAT). The rules for bringing EAT have been specified in Chapter VII of Part I of the ToR (see also Chapter XII, Part I of the ToR).

2. In the event of a joint application by the Contractors, the EAT shall be submitted by each of the Contractors applying for orderse. EAT should confirm compliance with the conditions for participation in the proceedings, no grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the proceedings and no grounds for exclusion. If the Contractor relies on technical or professional abilities, other entities, the Contractor shall submit a document confirming that the conditions for participation inand no grounds for exclusion for each entity, and evidence that the Contractor will have the necessary resources to the extent enabling the proper performance of the public contract and assess whether the relationship between the contractor and these entities guarantees real access to their resources. If it is necessary to ensure the proper conduct of the award procedureAt any stage of the proceedings, the Employer may request Contractors to submit all or some declarations or documents confirming that they are not subject to exclusion, meet the conditions for participation in the procedure or selection criteria, and if there are reasonable grounds to consider that previously submitted statements or documents are not already valid, to submit current statementse or documents.

6. The period of being bound by the offer specified in point IV.2.6 of the notice, i.e. two months, should be understood as 60 days
