1) The economic operators (tenderer, third party supporter, subcontractor) must not be found in the situations provided in art. 164, 165, 167of Law no. 98/2016. Method of fulfilling the requirement: "Completion of DUAE" by the economic operators participating in the award procedure with the information related to their situation, following that at the end of the evaluation of the contracting authority the contracting authority will ask the tenderer ranked in the first place the following supporting documents:

(a) fiscal certificate issued by ANAF attesting the lack of dataof outstanding debts at the time of deposit,

(b) certified local taxes and taxes attesting the lack of outstanding debts at the time of deposit

Note: in the situation of several working points, the requirement regarding local taxes and taxes will apply at least for the point / the work points involved in carrying out the contract,

(c) as the case may be, documents demonstrating that the workthe economic actor can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement,

(d) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control in within its framework, as it results from the certifying certificate issued by the ONRC / the constitutive document,

(e) other edifying documents, as the case may be;

Declaration regarding the non-compliance with the provisions of art. 60 of Law 98/2016. The economic operator (tenderer, third party supporter, subcontractor) will complete the corresponding requirement in the DUAE. The supporting document is submitted by all participants to the procedure (economic operator who submits the offer individually or in association, subcontractor or third party supporter) together with DUAE until the deadline for submission of tenders.

Requirement no. 1. The economic operators (bidder, third party supporter, subcontractor) submitting the offer must prove a form of registration under the law of the country of residence, to show that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constikilling and the fact that he has the professional capacity to carry out the activities that are the subject of the contract. The way of fulfilling the requirement: "Completion of DUAE" by the economic operators participating in the award procedure with the information related to their situation, following that at the end of the evaluation of the offers the contracting authority to request the tenderer ranked firstAres supporting documents: certifying certificate issued by the Trade Register Office, or in the case of foreign bidders, equivalent documents issued in the country of residence, will be presented only at the request of the contracting authority. The information contained in the supporting documents must be real / valid at the time of presentation. For legal / natural persons straine the documents proving a form of registration / certification will be presented in Romanian translation.
