Bidders, third-party suppliers and subcontractors must not be found in-the situations stipulated in art. 59, 60, 164, 165 and 167 of Law 98/2016, as amended and supplemented. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. With the filing of the DUAE document, economic operators will also submit the Declaration of Interestfailing to comply with the situations provided in art. 59 60 of Law 98/2016, with the subsequent amendments and completions.

The supporting documents proving the fulfillment of the assumed by the DUAE are to be presented at the request of the contracting authority by the economic operators ranked on the 1st and 2nd place - in the intermediate ranking completed evaluation of tenders.

The DUAE will be completed and presented according to art. 193 par. (1) of Law 98/2016, with the subsequent amendments and supplements. Note 1: The contracting authority excludes from the awarding procedure any economic operator that falls under any of the provisions of art. 59, 60, 164, 165 and 167 of the-Law no. 98/2016, with subsequent additions and modifications. Note 2: In case of association, the qualification criteria for the personal situation will be met by each associate. The legal form to be taken by the group of economic operators to whom the contract has been awarded; the contracting authority reserves the right to request the legalization of the association in the case-where the joint offer will be declared winning. Note 3: Each document will be signed by the legal representative of the bidder. If documents are signed by another person, they will be given a mandate.

Documents issued in a language other than Romanian will be accompanied by an authorized translation into Romanian.

The third person who supports the technical and professional / economic or financial capacity of the economic operator participating in the procedure as well as the subcontractor are obliged to submit the documents listed above

The way of defining offers with equal prices-to do so: If the commission finds that more than 2 admissible offers with identical car prices have been introduced in SEAP. contr. will submit to SEAP a request for clarification regarding the submission of new financing proposals. improved (two decimal places) and econ. will send their response using SEAP facilities, in which case the contract will be awarded to the bidderwhich has the lowest price.
