Framework agreement for the delivery of legal assistance to ATP - Private law. as a financial company is under the supervision of the Danish Financial Supervisory Authority. ATP is also a public-law bodysubject to a number of public-law rules. - The supplier must - by ATP`s ongoing needs - provide legal services to ATP in the form of private-law consulting and, in particular, the following areas: - 1) Leasehold and securities; - 2) Real estate; ) Financial instruments;
4) Financial regulation, including pension management and compliance;
5) Merger control;
6) Intellectual property law;
7) IT law / policy
8) M&A;
9) Private equity, including fund investments;
10) Company law.
ATP has a large number of lawyers employed in-house within various disciplines. The need for external legal assistance will therefore often entail that the external assistance consists of highly specialized competences within the various disciplines. Participation in the competition release can only take place electronically via the contracting authority`s applied electronic tender system (Mercell), cf. As soon as the application contains several editions (versions) of the same document, the latest uploaded version will be the one in question. All communications related to the competition release, including questionstemplate and answer must be made via Mercell.
The applicant must fill in and attach to the common European tender document (ESPD) directly in Mercell. For an association of companies (eg a consortium), a separate ESPD must be submitted for each participating economic operator. If an applicant is based on other units` form (eg a parent or sister company), the applicant must also submite support declarations or other documentation proving that the applicant actually lines this form. Template for support declaration is attached to the competition conditions. The other company (s) to which the applicant supports, must submit independent versions of the ESPD in Mercell.- 135 and 136 of the Danish Act on Exclusion of Exclusion.
In addition, the contracting authority will exclude applicants from participation in the competition release if they are covered by an exclusion ground in section 137 (1) of the Public Procurement Act. 1, no. 1, no. 2, no. 4, no. 6 or no. 7,
Unless the applicant has provided sufficient evidence that this is trustworthy in accordance with section 138 of the Public Procurement Act.If the ESPD is a statement of faith and law, then the Offeror will not, as a rule, be required to provide additional documentation for matters disclosed in the ESPD. However, ATP is entitled to request the Offeror for documentation of the information provided in the ESPD, as soon as ATP considers that this is necessary.section 159 (1) of the Public Procurement Act. 5, if applications or offers do not meet the formal requirements of the competition material.
It should be noted that each applicant can only submit an application for pre-qualification. point II.1.6) The reason for not dividing the framework agreement into subcontracts is that it is assessed that better prices and better coherence in ATP`s total tasks can be achieved by not dividing into severallkontrakter. However, ATP has also divided legal assistance into two separate framework agreements, respectively. one about private law (the present competition) and one about public law. Item IV.1.3) Collection of competition involves the drawing up of a framework agreement - a technical error in point IV.1.3.
