Delivery of glass and small laboratory equipment for laboratories of the Main Inspectorate of Commercial Quality of Agricultural and Food Products

The subject of the order is the supply of glass and small laboratory equipment for the laboratories of the Main Inspectoratu of the Commercial Quality of Agricultural and Food Products. The order will be awarded in 5 parts. Part of the order is the chapter: Chapter I delivery of glass and small laboratory equipment to the Specialist Laboratory GIJHARS Gdynia. Chapter II - delivery of glass and small laboratory equipment to the Specialist Laboratory of GIJHARS Lublin. Chapter III - glass and small deliverylaboratory equipment for the Central Laboratory of GIJHARS Poznań. Chapter IV delivery of glass and small laboratory equipment to the Specialist Laboratory GIJHARS Kielce. Chapter V - delivery of glass and small laboratory equipment to the Specialist Laboratory of GIJHARS Białystok. A detailed description of the subject of the order has been included in point 3 Specification of Essential Order Conditionsia and in the price form, constituting Annex 2a to the SIWZ.

The subject of the order is the supply of glass and small laboratory equipment to the Specialist Laboratory GIJHARS in Gdynia. A detailed description of the subject of the order has been includedin point 3 of the Specification of Essential Terms of Orders and in the price form, constituting Appendix 2a to the ToR - The Ordering Party does not set a condition in this respect. Contractors who meet the conditions for participation in the proceedings regarding technical or professional capacity and can not be excluded on the basis of the conditions set out in Article. 24 sec. 1 point 12-23and paragraph 5 points 1 and 8 of the Act. In the case of Contractors jointly applying for the award of a contract, the condition specified in point 5.1.1. The ToR must meet at least one Contractor, while the terms of point. 5.1.2. The ToR must be performed by each Contractor individually. The ordering party, based on art. 24 aa paragraph 1 of the Act, first evaluate the offers, and then examine whether the Contractor whose offer has beenassessed as the most advantageous, it is not subject to exclusion and meets the conditions for participation in the proceedings. This study will be carried out on the basis of a statement attached to the offer submitted in the form of a Single European Order Document, constituting a preliminary confirmation of the lack of grounds for exclusion and compliance with the conditions for participation in the proceeding, hereinafter referred to as "EAT", andand the documents and declarations submitted at the request of the Employer confirming the lack of grounds for exclusion and fulfillment of the conditions for participation in the proceedings. The EAT formula was defined in the Commission Implementing Regulation (EU) 2016/7 of 05/01/2016 establishing a standard form for a single European order document (OJ L 3 of 06.01.2016, page 16). Contractors are seeIt is required to attach to the offer current on the day of submitting offers of EAT, in accordance with point 6 of the ToR. The research will be subject only to the EAT submitted by the Contractor, whose offer has been evaluated as the most advantageous.
According to art. 22a para. 1 and par. 2 of the Act, the Contractor may confirm the fulfillment of the conditions for participation in the proceedings, in appropriate situations and with regard to a specific order, or parts thereof, rely on the technical or professional abilities of other entities, regardless of the legal nature of the legal relationships that it has with it. The Contractor, who relies on the abilities of other entities, must prove to the Employer that while fulfilling the order, he will have the necessary resources of these entities, in particular presenting the commitment of these entities to givehim at the disposal of the necessary resources for the implementation of the order. The Contractor is obliged to attach to the offer the obligation of the third party to provide him with the necessary resources for the needs of the order. The obligation or other documents confirming the provision of resources by other entities must clearly and unambiguously result in particular: a) scope(b) manner of using the resources of another entity, by the Contractor, in the performance of the public contract, c) scope and period of participation of another entity in the performance of the public order.To pre-confirm compliance with the conditions for participation in the procedure, as set out in point 5 of the ToR and demonstrating the lack of grounds for exclusion, the Contractor, based on art. 25a para. 2 and par. 3 point 1 of the Act, it adds to the offer a statement in the form of EAT, valid as at the day of submitting bids. In addition, the Contractor who relies on the resources of other third parties to demonstrate the absence of grounds for exclusion against them and fulfillment of the conditions for participation in the proceedings to the extent to which he relies on their resources also submits separate EAT regarding theselitters (for each entity separately). The Ordering Party informs that the Contractor, when completing the statement on the EAT form, may also use the tool available at: https://ec.europa.eu/growth/tools-databases/espd/ or http://espd.uzp.gov.pl. Contractor when submitting EAT is filled in by: Part II Information about the contractor, Part III. Basis of exclusion, Part IV. Eligibility criteria(only the α section - "general statement regarding all eligibility criteria"), Part VI - Ordering party does not impose a condition in this respect In accordance with Article 24 paragraph 8 of the Act, the Contractor who is subject to exclusion pursuant to Article 24 (1) points 13 and 14 and 16-20 or paragraph 5 point 1 and 8 of the Act, may provide evidence that the measures taken by him are sufficient to demonstrate theirreliability, in particular to prove the damage caused by a crime or fiscal offense, financial compensation for harm suffered or remedied, an exhaustive explanation of the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources that are appropriate to prevent further crimem or fiscal offenses or improper conduct of the Contractor. The provisions of the first sentence shall not apply if the Contractor, being a collective entity, has been the subject of a final court decision prohibiting him from applying for the order and the period of validity of the prohibition specified in that judgment has not expired. The Contractor is not subject to exclusion, if the Employer, taking into accountaga and special circumstances of the Contractor's action, he will deem sufficient evidence provided under this SIWZ.
Contractor within 3 days from the date of posting information on the website of the Employer, referred to in Article. 86 par. 5 of the Act, is obliged to provide the Employer with a declaration of belonging or non-affiliation to the same capital group, aboutmentioned in art. 24 sec. 1 point 23 of the Act. With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. The ordering party will call the Contractor whose offer has been the highest rated, to submit within the prescribed, not shorter than 10 days, the valid day as of the day of submitting the statements or the dockmentions confirming the circumstances referred to in art. 25 para. 1 point 1 and 3 of the Act, i.e.: 1) the order of deliveries made, and in the case of periodic or continuous services also performed, in the last 3 years before the deadline for submission of bids, and if the period of business is shorter in this period, along with their values, subject, dates of completion and entities, onwhich the deliveries were made (Annex No. 5 to the ToR), and attached with evidence determining whether these deliveries were made or are duly performed, whereby the evidence referred to are references or other documents issued by the entity for whose delivery were performed, and in the case of periodic or continuous services are performed, and if for a justified reasonof an objective nature, the Contractor is unable to obtain these documents a statement from the Contractor; in the case of periodic or continuous services, references still to be made, or other documents confirming their proper implementation should be issued not earlier than 3 months before the deadline for submission of tenders; 2) information from the National Criminal Record in the scope specified in art. 24 par. 1 points 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of bids; 3) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submission of bids or other document confirming that the Contractor has entered into an agreement with the competent authoritiesa tax brigad on the repayment of such receivables, together with any interest or fines, in particular obtaining the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the execution of the decision of the competent authority;
