Subscription service and technical and functional development of components included in the BIFB SWIFTNet infrastructure

The procurement is awarded through a framework agreement and includes the following activities:

The contract is awarded through a framework agreement and includes the followingyour activities:

1.1. Subscription service - for 4 years from 25.1.2020. In case the contract is concluded later than 25.1.2020, it will be effective from the date of signing.

1.2. Design, development and implementation of enhancements, modifications and additions (hereinafter alternatively "system updates" or "functional development") to components included in SWIFTNet Infrastructurethe structure of the Bulgarian National Bank - an approximate volume of 1 856 man-hours over a period of 4 years.

1.3. Warranty support for relevant system updates. Upon expiration of the relevant warranty maintenance period, the service of the relevant updates shall become part of the subscription service of the system under item 1.1 without an increase in the cost of the subscription service.your and the manner of performance of the individual services under item 1.1 and item 1.2, as well as the rights and obligations of the parties in connection with the performance of each service will be determined in the respective contract (s) concluded on the basis of the framework agreement and according to the offer of the selected contractor for each specific contract.

The contracting authority removesis in the procedure a participant for whom any of the grounds under Art. 54, para. 1 of the PPA:

1. who has been convicted by a sentence of art. 108a, Art. 159a - 159d, Art. 172, Art. 192a, Art. 194 217, Art. 219-252, Art. 253-260, Art. 301-307, Art. 321, Art. 321a and Art. 352-353f of the Criminal Code;

2. who has been convicted by an enforced sentence of an offense similar to those referred to in point 1 in another Member Stateor a third party;

3. who has duties for taxes and compulsory social security contributions within the meaning of Art. 162, para. 2, item 1 of the TSCC and the interest thereon to the state or the municipality at the registered office of the contracting authority and the participant, or similar obligations established by an act of a competent authority according to the legislation of the state in which the participant is established, evidenced by force act of comptent authority (where their amount exceeds 1% of the participant`s annual total turnover for the last financial year ended, but not more than BGN 50 000);

4. for whom there is inequality in the cases under Art. 44, para. 5 of the Public Procurement Act;

5. found to be:

a) presented a false document related to verifying the lack of grounds for removal or fulfillment of a criterion(b) failed to provide the required information related to verifying the lack of grounds for the removal or fulfillment of the selection criteria;

6. for whom it has been established by a penal decree or court decision, violation of Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 118, Art. 128, Art. 228, para. 3, Art. 245 and Art. 301 305 of the Labor Code or Art. 13, para. 1 of the Labor Migration and Labor Mobility Act, or similar obligations established by an act of a competent authority under the law of the country where the applicant or participant is established;

7. for whom there is a conflict of interest within the meaning of - 2, item 21 of the PDA, which cannot be eliminated.

On the grounds of Art. 55, para. 1, item 1 of the Public Procurement Act, the contracting authority removes from Artin the procedure a participant declared bankrupt or in bankruptcy proceedings or in liquidation procedure or has concluded an out-of-court agreement with its creditors under Art. 740 of the Commercial Code, or ceased its activity and, if the participant is a foreign person, finds itself in a similar situation resulting from a similar procedure under the law of the state in whichstate. Pursuant to Art. 3, item 8 of the Law on Economic and Financial Relations with the companies registered in preferential tax jurisdictions, the entities controlled by them and their beneficial owners, the companies registered in the preferential tax regime jurisdictions and the entities controlled by them directly or indirectly participate in the procedure, including through citizensa company / consortium in which a company incorporated in a preferential tax jurisdiction is a member.
