The tenderer produces the Single European Market Document (DUME), which consists of a declaration on the honor of his own updated and which eIt is accepted by the contracting authority as a priori evidence in lieu of documents or certificates issued by public authorities or third parties to confirm that the tenderer is concerned:

1) is not in one of the following situations: exclusion referred to in articles 67 to 69 of the law of 17.6.2016;

2) meets the applicable selection criteria which have been established in accordance with-Article 71 of the law of 17.6.2016.

The contracting authority can ask the bidders, at any time of the procedure, to provide all or part of the documentsif necessary to ensure the proper conduct of the procedure.

In accordance with Articles 62 and 63 (2) of the Royal Decree of 18 April 2017, the contracting authority shall electronically check Telemarc for tenderers employing in Belgium that it is:

- in rule as for the payment of the social contributions (ONSS), social debts,

- in rule for-his tax obligations.

In accordance with Article 63 -3 of the Royal Decree of 18.4.2017, where the verification referred to in the preceding paragraph does not make it possible to ascertain whether the candidate or the tenderer satisfies his fiscal obligations, the power of attorney Contracting Authority shall request directly from the applicant or tenderer to provide a recent certificate proving that he satisfies his obligationsns tax. The same applies if in another Member State such an application is not available.

The above-mentioned certificate is issued by the competent Belgian and / or foreign authority and certifies that the candidate or tenderer is in compliance with its tax obligations in accordance with the legal provisions of the country in which it is established.

The tenderer must provide thethe successful tenderer an extract of a criminal record valid for less than 6 months at the date of submission of tenders, confirming that the tenderer is not in one of the cases referred to in Article 67 (1), 1 to 7 of the law of 17.6.2016 and article 61, 1 to 7 of the RD of 18.4.2017.

Corrective measures:

In accordance with Article 70 of the Law of 17.6.2016, any tenderer who is in the 'one of the situations referred to in Articles 67 and 69 may on its own initiative provide evidence that it has taken sufficient steps to demonstrate its reliability.
