1. The scope of the orders includes:

Main Site: City of Katowice, POLAND

1. The subject of this order is "Construction of the monitoring systemat the sewerage network in Katowice ".

2. The scope of the orders includes:

1) Construction of Weather Stations

- delivery and installation of 3 new Weather Stations for measuring atmospheric precipitations and other weather parameters,

- extension of the application [RainBrain] for acquisition of measurement data coming from new weather stations,

- data transmission from measurement stations, via GSM / GPRS network, toapplication data server [RainBrain],

- tests and start-up.

Weather stations will be located in the following pumping stations:

- Sewage pumping station "Marcin", Katowice, Marcin street

- Sewage pumping station "Kołodzieja", Katowice, ul. Szarych Szeregow / Tartaczna

- Sewage pumping station "Borki", Katowice, Borki street

2) Construction of a sewage network monitoring system includeconstruction of a total of 156 Measurement Points monitoring the sewerage network, exchange of manholes to the well-sewer chambers, the construction of burglar-proof security on the manholes and the implementation of the SCADA system. The transmission of data from Measuring Points to the SCADA system will take place via GSM / GPRS modems.

The following works can be distinguished within the scope of the task:

- construction of 61 Measuring Points, volumewastewater flow rate,

- construction of 95 Measuring Points for the filling height of channels,

- implementation of the SCADA System,

- replacement of manholes to wells and sewage systems, and the installation of burglar-proof security systems on the manholes

Under the term "Measuring point" should be understood a complete set of measuring devices, along with the power supply, recording and transmitting data to the SCADA system.

4. A detailed description of the subject of the order can be found in Attachment No. 6 to the ToR. Description of the subject of the order.

Wherever the description of the subject of the order refers to a specific supplier or producer of a device or material or a particular device or material, it should be understood as an example solution indicating only their technical parametersical. The Employer allows the use of equipment and materials of other producers or suppliers, provided that these devices (materials) will have technical parameters and quality not worse than specified in the documentation.

1. Contractors, who are not subject to exclusion, may apply for the order.

2. Each contractor must submit a formal statement as at the day of submitting bidsie Single European Order Document (EAT) within the scope indicated in Annex 2 to the ToR. The information contained in the statement will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure. In the event of a joint application for contracting by contractors, a declaration in the form of a Single European Order Document (JEDZ) submits each of the contractors jointly applying for the order. This statement is to confirm initially that there are no grounds for exclusion from the procedure and that the conditions for participation in the proceedings are met, in which each of the contractors demonstrates compliance with these conditions. Contractor who refers to the resources of other entities in order to demonstrate the lack of existence after themexclude exclusion and fulfillment - in the scope in which it refers to their resources - the conditions for participation in the proceedings also include a declaration in the form of a Single European Order Document (EIN) concerning these entities. The declaration must be completed and signed by a qualified electronic signature by this entity. The ordering party does not demand from the Contractor that it intends to entrustexecution of a part of the order for subcontractors to submit a declaration in the form of a Single European Order Document (EIN) concerning these subcontractors.

6. The ordering party shall call the contractor whose tender has been the highest rated, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting the following documents:

1) information from the countrythe Criminal Record in the scope specified in art. 24 sec. 1 point 13 lit. a) -c), point 14 and point 21 of the Act, issued not earlier than 6 months before the deadline for the submission of tenders - (in the case of Contractors jointly applying for the award of the document, each entity submits), - 2) excerpt from the relevant register or from the Central Register and Information on Economic Activity, hedgehogIf separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 points 1 uPzp

(in the case of Contractors jointly applying for the order, the document is submitted by each of the entities),

Contractor within 3 days from the date of posting on the website information referred to in art. 86 par. 5 uPzp, will forward the ordera declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law With the submission of a statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure. Additionally, the Contracting Authority foresees exclusion of the contractor:

1) in relation to which onedecommissioning has been opened, the arrangement approved by the court in the restructuring proceedings provides for the satisfaction of the creditors by liquidation of its assets or the court ordered the liquidation of its assets pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring Law (Journal of Laws of 2017, item 1508 and 2018, item 149, 398, 1544 and 1629) or whose bankruptcy was announced, except ina wholesaler who, after the bankruptcy, has concluded an arrangement approved by a final court order, if the arrangement does not provide for the satisfaction of the creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of his property in accordance with art. 366 para. 1 of the Act of 28.2.2003 Bankruptcy Law (Journal of Laws of 2017, item 2344 and 2491 and of 2018 item 398, 685, 1544 and 1629);

2) which, within lieu of his side, he did not perform or improperly performed a significant contract for a public order or a concession contract, concluded with the ordering party referred to in Art. 3 par. 1 point 1 4 uPzp, which led to the termination of the contract or award damages.

2. If the contractor relies on the abilities or situation of other entities on the terms set out in Article22a uPzp, presents in relation to these entities the documents listed in part III.1.1) confirming the lack of grounds for exclusion from the proceedings. In the case of statements or documents, the Contractor is not obliged to submit them, if the orderer has statements or documents regarding this contractor or can obtain them through free and publicly available databases, with the reservationthat in such a case the contractor is obliged to indicate the availability of these documents or declarations. If the documents or statements regarding the contractor are available in electronic form at specific Internet addresses of free access to free databases, the contracting party will download them on their own after they have been identified by the contractor. If documents or statements regarding thethe offenders are in the possession of the ordering party, the ordering party uses them after being indicated by the contractor, if they are up to date (not applicable to the statement in the form of the EAT).

4. Documents or statements referred to in point III, are submitted in the original form in the form of an electronic document with a qualified electronic signature or in an electronic copy of the document or statement will be usedcompliance with the original. The attestation of compliance with the original is made by the contractor, the entity on whose capacity or situation the contractor or each of the contractors jointly applying for the award of a public order, in the scope of documents or statements that relate to each. Certification of compliance with the original of an electronic copy of a document or educationthe attachment is made using a qualified electronic signature. Documents or statements made in a foreign language are submitted together with a translation into Polish.

5. In the scope of non-regulated SIWZ, the provisions of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the procurement procedure apply.(Journal of Laws of 2016, item 1126, as amended) and the regulation of the President of the Council of Ministers of 27 June 2017 on the use of electronic communication media in public procurement proceedings and the provision and storage of electronic documents (Journal of Laws of 2017, item 1320, as amended).

6. The Contracting Authority provides for the application of the procedure indicated in art. 24aa uPzp (the so-called "percentodwrocona procedure ").
