Means of proof of reliability are in accordance with Art. 56 of the Public Procurement Act. The use of the capacity of third parties is in accordance with Art. 65 of the Public Procurement Act. In case of a subcontractor the provisions of Art. 66 of the Public Procurement Act. In the case of a joint venture, the assignor sets the conditions under Art. 37, para. 3 and para. 4 of the PPPP. The submission / receipt of tenders is in accordance with Art. 47 and Art. 48 of the RSPC. The receipt of tenders and additional documents is in accordance with Art. 28, para. 4 of the PPPP

Terms and method of payment.

The invoicing should be according to the VAT Act. Advance payment:

The Contracting Authority provides an advance payment by bank transfer at the rate of 20% of the contract value within 30 calendar daysand from the date of the submission of a guarantee guaranteeing 100% of the amount of advance funds and an original invoice. The selected contractor shall submit a guarantee guaranteeing 100% of the amount of advance funds at the time of signing the contract and shall be released within 3 days after the drawdown of the advance in accordance with Art. 111, para. 3 of the PPL.

The advance guaranteeThe means are provided in one of the following forms:

1. cash amount; bank guarantee; insurance that ensures performance by covering the contractor's liability.

The participant designated as a contractor shall choose the form of the guarantee for the advance provided. Final payment: 80 of the contract value is made by bank transfer within 3 days0 calendar days with effect from the date of the final acceptance report on the template of the assignor and an original invoice issued in advance approved by the contracting authority. The Contracting Authority does not allow variants of offers.

Performance guarantee: 3% (three percent) of the contract value excluding VAT.

Validity of the performance guarantee:

- 2% of the contract value is up to 30 calendardays after the arrival of the school tower and the presentation of the final acceptance report,

- 1% of the contract value is up to 30 calendar days after the expiration of the longest warranty period

The assignor shall release the guarantee ensuring the performance, in stages and within the 30 days from the occurrence of the respective event as follows:

- 2% of the value of the contract after the expiry of the term-

1% of the value of the contract after the expiration of the longest warranty period according to techn. proposal of the contractor

The Contracting Authority concludes with the appointed contractor a written contract for the public procurement under the terms and conditions of Art. 112 of the Public Procurement Act. When the procurement contract is concluded, the measures to prevent the use of the financial system for the purpose of launderingof money under the Law on Measures Against Money Laundering (MIMA) and the acts for its implementation.
