Requirements for Exclusion Reasons

Mandatory will be initially completed and presented by DUAE by tenderers / candidates (including Associates / subcontractors / third advocates) as the first proof of non-compliance in situatiilexclusion and capacity requirements.

Requirement no. 1

The economic operator (individual bidder, member of an association, subcontractor, third-party supporter) or any person who is a member of the board of directors / management, supervisory or supervisory bodies, or who have the power to represent, control within it is notn none of the situations mentioned in art. 164 par. (1) of the Law no. 98/2016, on the grounds for exclusion of criminal convictions. 2

(1) and paragraph (2) of the Law no. 98/2016] applies to economic operators for whom this infringement has been established by a defined court orderor definitive and binding administrative decision in accordance with the law of the State in which the economic operator is established or for which the contracting authority can demonstrate, by appropriate means, the breach of obligations to pay taxes, duties or contributions to the general consolidated budget .

The economic operator is not excluded from protation if he has paid the said obligations or has waived his obligations by other means of extinguishment or has a payment order or other facilities for extinguishing these obligations under the conditions specified in art. 165 par. (3) of the Law no. 98/2016, before the contracting authority makes the exclusion decision.

The contracting authority has the right, according to the provisions of art.166 par. (2) of the Law no. 98/2016, to maintain an economic operator in the award procedure, even if it finds itself in the situations described in art. 165 paragraph (1) and (2) when the amount of such payment obligations is below the threshold provided in art. 166 par. (2) of the Law no. 98 / 2016.

In order to submit requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP www.e-licitatie.ro as an economic operator, according to the provisions of art. 5 par. (1) of H.G. no. 395/2016 sishall transmit the requests taking into consideration the contracting authorities' terms of reference provided for in art. 160 161 of Law no. 98 / 2016.

The contracting authority will conclude a framework agreement with a maximum of 3 tenderers.

An offer that is not accompanied by proof of the provision of the guarantee under the instructions will be rejected by the contracting authority at the time of opening the tender(The bid is not denied at the moment of accessing it, when the guarantee of participation:

(a) Established as a guarantee instrument is presented according to the instructions, but in another form, amount or period of validity than required. Exceptionally, the contracting authority ais entitled to conclude with another economic operator a public procurement contract for the purchase of the same products subject to the framework agreement if the economic operators signing the agreement are no longer able to respond to the contracting authority's requests. which, in the framework of the award procedure for the subsequent contracts, has two or more of themsubmit a financial proposal of the same value, the contracting authority will ask them for a new financial proposal, the subsequent contract to be awarded to the bidder who submitted the best bid.
