The manner by which the fulfillment of the requirements can be demonstrated: It will be completed by the economic operators participating in the award procedure with the information related to their situation.-joint offers DUAE will be completed by each economic operator separately. • The supporting documents proving the fulfillment of the assumed completion by the DUAE shall be submitted at the request of the contracting authorities only by the tenderers placed on the first three places, in class(tenderers with whom the contracting authority will conclude the framework agreement), as follows:

Requirement 1: The criminal record of the economic operator and of the members of the management, management or supervisory body of the economic operator or of the economic operator which have power of representation, decision or control within it, so withm results from the certifying certificate issued by ONRC - in order to prove non-compliance with the provisions of art. 164 of Law no. 98 / 2016.

Requirement 2: Establishing certificates for the lack of overdue debts, according to the provisions of art. 165 of Law no. 98/2016, as follows:

- Certificate of Local Taxes and Fees Issued by the Taxes and Local Taxes Department as a tenderer- The certificate of fiscal attestation issued by the Public Finance Administration for the obligations to pay to the budget, showing that the tenderer has no outstanding debts at the time of the presentation.

Note: The foreign legal / natural persons, who want to participate in the procedure, present any editorial documents issued by the authoritiescompetent in the country where they are resident, to prove the fulfillment of outstanding taxes and social security obligations at the time of their presentation.

Note: The local tax and local tax certificate will be presented both for the registered office and for the registered office. for secondary premises, as well as point / work points for which there are obligations dit is payable.

Note: The documents presented in a language other than the Romanian language will be accompanied only by the authorized translation in Romanian. Where appropriate, documents shall be provided demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98 / 2016.

Requirement 3: Statement according to art. 58 on non-compliance-in the situations provided by art. 60 of the Public Procurement Law no.98 / 2016.

Means of performance: Declaration on own responsibility, signed and stamped by the legal representative of the tenderer - Form no. 5

Note: The declaration on non-compliance in situations potentially generating conflict of interests will be submitted by bidders, third parties and subcontractorstogether with DUAE. This form must be submitted by the bidder / associated offeror / third party / subcontractor (as the case may be). In the case of an association, this requirement must be met by all members of the association.

The way of ranking the first ranked offers with equal prices: authoritythe contractor will ask the tenderers for a new financial proposal through the SICAP and the subsequent contract will be awarded to the tenderer whose new financial proposal has the lowest price.
