Not applicable - 1. The Employer will apply the mandatory conditions for exclusion from the proceedings set out inArt. 24 sec. 1 point 12) -23) upzp, including the provisions of art. 133 ust. 4 upzp.

2. According to art. 24aa of the Act, the Employer will apply the so-called reverse procedure, i.e. it will first evaluate the bids and then examine whether the Contractor whose bid assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. Before ordering, in accordance with the instruction of art. 26 par. 1 upzp, the Ordering Party, via tools placed on the Electronic Offer Form (EFO) platform, will call the Contractor whose offer has been the highest rated, to submit in a designated period of not less than 10 days as of the day of submitting statements or documents confirming the circumstances referred to in art 25 para. 1 upzp, listed and described in detailbelow.

4. The complete offer must contain documents and obligations contained in part XVII of the ToR.

5. Contractors may request the Ordering Party to clarify the content of the ToR. Details were specified in part XVIII. Terms of Reference.
